parental right termination

ok my son was born aug. 26th 2007 i left his father feb 19th 2008 considering he was an alcholic a drug abuser and he verbalally and physically abused me. i was with him for 2 1/2 yrs. Anyway I live in New jersey and he lives 2 towns over not bad maybe 25-30 min drive. well since i have left him he's only taken his son twice when he was like 7 months old( now over 2 yrs old) and both of those times he has called me to come get him b4 11pm n only having him since 8pm. anyway i was wondering how long should i wait to try and terminate his rights?? its been six monthssince he has seen him( mother's day to be exact) ever since then he doesnt show and when he does eventually call all he talks about is his new fling of the week or how he is trying to straigthen out his life NOTHING AND I MEAN NOT A WORD ABOUT HIS SON. I want to get his rights terminated but was wondering if it was too soon. also never paid his child support and its up to $8,000

I would now. Even if he has seen him its only been twice. Plus if he still has problems you dont want your son around him now anyways. Do you already have a custody agreement?

Look into what the parental termination rights are for your state. Some states have it set so that after a certain amount of time (6m, 12m, 15m, 24m, etc) parental rights are automatically terminated.

I would do itasap because as far as I know it could be diffrent for diffrent states but he has to have no contaced for at least a year and child support is considered a from of contacted which sucks! Ive been wantingto do this with my daughters realfather for years and I cant because of him paying the court ordered child support which comes right out of his check.

You can deny him right this very second. If he hasn't paid child support, then you have the right to terminate/deny him. Well, at least it's that way in TN. Plus, if he's doing all that stuff, I know you wouldn't want him around that crap.

Where in Jersey do u live? b/c u can get his right termination now if u really want too

you need to get a lawyer. Getting rights terminated takes time of evidence that he isn't supporting or having anything to do with helping raise the child. I don't know how long it is but they watch for awhile then take to court and report to the judge proof that he isn't a good parent and then he may get his rights terminated. I'm trying to do the same thing with my BD (hes in jail right now) and it is going to take time before it actually happens.

yes he is supposed to pick him up every friday at noon to sunday at 8pm and doesnt i mean he has come over to see him but maybe 10 times tops and some he was a no show. we have a paper he signs everytime he comes actually i'll type them in. he showed upon my sons bday 3 hrs late (826-0  then 12-14-08 no show no call... 12-18-08 showed 513 to 630...2-4-09 showedunannounced at 140 stayed till 240 gave me $20... 3-1-09 no show 3-29-09 no show but called april 7th to say he was in a car accidentand was in the hospital since the 28th but no proof... 4-19-09 no show then mothers day 5-10-09 showed but i had him aressted for not paying childsupport and driving w/o a license
