I think that the child support thing might hold you back.

child support wont hold you back and if you felt threatened and he took the phone then he could get in trouble with the law

Every parent goes through a rough time. I don't think they would just automatically give your bd full cusody based on you not having a job, etc. However, the child support could be a problem.
