crazy SIL birth certificate question

So my ex SIL is a little crazy and is still in love with my brother. She got pregnant by a new guy and she gave the baby my brothers last name? She said because she kept the last name after the divorce and her first son(my brothers child) has that last name. Now I am wondering when she gave birth to this new baby if she could have put my brother down as the father? No one was there to see and I wouldn't put it passed her. But would my brother had to been there for his name to be put on the certificate or could she just have randomly put him down since the baby does have my brothers last name?

She can put any last name she wants without the father signature.

I see why she'd put you're brother's name. They were married, it's her last name, her one child's. I wouldn't want my kids to all have last names, how would he feel if she changed his last name to the new spouses last name? Personally I'd go back to my maiden name for all of them. but I don't think that makes her crazy

If they are divorced I think he would have to sign but I'm not sure. I know that with my son we weren't married yet and my hubby had to sign so idk.

As far as I know, he doesn't have to be there OR sign anything. I can kind of see why she would do it bc it is her last name and her son's last name, but its still alittle weird since they have different dads. I don't know lol.. but if I were him, I'd ask to see the BC just in case. If she did do it, he will have to get a DNA test done.

I don't even see what the big deal is honestly. It's a name, I could see if she changed his kid's name to her new bf's.

I don't know about that all I know is that when you have a baby and if you didn't get divorced it automatically says the person you are married to their name.

Are you kidding me? She gave her new child who has nothing to do with my brother HIS last name? The father to the new baby is a loser but he wanted to be involved in his sons life and now that man has to look at HIS son with his ex girlfriends ex husbands last name? that to me equals crazy!

I guess it's not a huge deal to me. It might be to the actual father, but it's not him posting this thread.

I know it sucks for the whole family to have all diff last names but when that baby gets older and asks his mom why he doesnt have HIS fathers name and some randon guy she was previously married to its going to be hard to explain. I personally dont know why she didnt go back to her maiden name well I do know its cause she is still infatuated with my brother but I dunno its weird to me

i'm in PA, and in my state ...

you can put whatever last name you want on the birth certificate, BUT you cannot list someone as the father unless:

a) you're married to them.
b) they fill out paternity acknowledgement paperwork with you.

(i've done it twice; my fiance and i have our two boys and aren't married. we had to fill out the paperwork to have him on the birth certificates.)
