military ladies, question

I know, I know, there's a thread for the military however I'm having issuses at the moment so just leave it be.

First of all, long time no post! I miss all of y'all! How've you been?

As most of you know, Jason and I are currently going through a divorce. &hey, guess what?! He's deploying to Iraq next week! Yay for pushing my divorce back another 1 1/2 - 2 years!  
In the meantime, we're still married. Correct me if I'm wrong, but as long as we're still married that BAH in which he's recieving is supposed to be for Lucas and I to have a place to live, not him? Correct? Which means, I'm not supposed to be getting a PORTION of it in child support, I should be recieving the amount in full....?

His BAH is for all three of you. Same as his BAS.

no you get half of it but in my brothers case that was not counted in his child support it was on top of it. but as long as your still married the house is yours to live in housing if for the spouse not the soilder.

I was just told yes that is for you. He wouldn't have it if it wasn't for you and Lucas.

That's just it though, I don't live on base. We've been separated for over a year. But can't get a court date to finalize until he's deployed and the judge won't finalize without him there. It's all a bunch of hooey. So in return, Lucas and I get to live at home with my parents because I can't afford an apartment or anything for us.

what rank he is depends on the amount of BAH he recieves and then in turn depends on the amount of "support" or bah you get until the divorce is final.

im confused, you two are still legally married and he pays child support? or are you legally seperated?

He could get BAH without u two, depending on rank.
And IMO if u get child support than you two are basically not married and in that case you wouldnt get any of his BAH.

that make sense? tho, im not sure of the legal aspect of your situation, so theres a big chance im wrong.

When I went home 2 weeks ago I contacted JAG and that is what they told me. I dunno I would say maybe contact them or your lawyer.

Hannah, you need to contact JAG instead of asking on here baby cakes.   That way you can explain your exact situation and they can give you an answer by their regulations.

But Whitney, I have no JAG to contact. When I left he was at Irwin, he's not there anymore. Now he's at Stewart. Oh, and dumbass told me the other day he was taking his Warrior Leaders course so he can get his E-6 in Iraq. but now he's pissed off i'm trying to go back to court for more child support?! Please, like i'm going to leave it to him to just give me more on his own and not on paper.

I thought WLC was before E-5 and BCNOC was before E-6. Mama is confused. Scott is going to BCNOC in 2 1/2 weeks. He went to WLC before ever making E-5.

And you could call any JAG. I will even PM you the number to ours.
