anyone good with legal stuff?

My sister was just fired because she is going to havesurgery on her kidneysand they would not allow her the time off. she has only been there 7 months, but the probationary period is over. she hasnt missed any except a couple of days when she was in the hospital and she called with ample time. i am so sad about this because her husband was just laid off too. is this legal?? because it seems like it shouldnt be to me. on her notice, they didnt even put it was medical they put because of an extended leave request. i feel like they are trying to cover their butts. Any info you can direct me to would be great. thanks ladies.

It's not legal. It's considered a health emergency. I'd speak with a lawyer.

I would too..she can atleast draw unemployment.
But that is highly fucked up of her employer.

It is not legal if it is a medical emergency. My neighbor is going through the same thing with his job right now. Speak to a lawyer and know the law in your state.

some states are allowed to fire you without a reason. also she doesn't fall under any family leave acts because she's only been there 7 months and you have to be there for 12...

They cant fire you if you have a doctors note excusing you. You will have to check the laws in your state and contact an attorney if they really want to pursue it most of the time it inst worth it because the employer could just say her work performance wasnt up to par or whatever BS they make up to cover their arses.

TN is a "right to work" state.
They don't have to give you a reason for firing you, is what that means.
The law in this state is completely in favor of the employer.
It's legal what they did, but shitty all the same.


I used to work for a labor union in Kansas, also a right-to-work state. The law needs to change. Without saying so, employers were firing people for using FMLA. But since they didn't need to give a reason, it wasn't illegal.

She can try for unemployment for being let go for a medical reason.. its worth a shot.
