which states drug test babies/their mom's?

I'm just curious, because i've never heard of anyone getting their baby taken away because of this, unless the mom was a hard core drug addict, my cousin had a miscarriage a while back & i KNOW she took pain pills, zanex, smoked cigarettes ect. I'm just wondering why she still has her other children? is it only some states that do this? i would just think because of her situation they would have done some tests on her still-born to determine the cause...... and i'm not one to turn people in, i tend to keep everyone else's drama out of my life as much as i can, but i've been wondering this, I think of her baby often, especially now that i'm carrying a baby girl & i keep thinking that maybe God took her baby away & decided she needed a better mother... (she was having a girl too) it's just something that's been on my mind & i was just curious if anyone knows what states do this & which don't..... also, would they do it without consent or do you have to give consent? she's trying to get pregnant again, and i'm thinking i may have to say something if she continues to make the same choices if she gets pregnant......

My mom got my sister taken away from her because she smoke crystal meth through her whole pregnancy. Got her back the next day though.

In NY if there is a suspision (sp?) they will test W/OUT parenatal consent.

they do it in idaho. i dont know of a state that wouldnt take the kids away if the parents/mother was using. oh, they do it in washington, too.

tn only does it when they think the mother is abusing. cause i know alot of people that did drugs while pregnant and none had their kids taken away

Arizona does not unless there is reasonable suspicion.

I live in VA and my Dr drug tested me with my 2nd but the first time Iwas preg my other Dr didnt. He didnt ask tho either.. I just saw it on my bloodwork papers. I asked if it was normal and the lady at the lab said yes. I didn't know that.

I know CA will, when I was in the hospital with my daughter as I was getting in the room, the roomate was leaving without her baby. She got her baby taken away, the baby tested pos but im not sure what drug. My nephew was born while his mother was in jail so he got taken away at birth and he tested positive. My bro has custody of him now.

Nevada doesnt have a law I think, but if they think you've taken drugs or you've had no prenatal care they will. My SIL was trying to get on medicaid her whole pregnancy, but since she's only 17 other people had to do it for her, and they weren't following through so she never got it. She had 3 appointments her whole pregnancy. They drug tested her and they ended up finding something in her urine. They said it was a anxiety medication they found. We went through this whole thing with CPS and she had a bunch more drug tests done including hair tests, and finally it was dropped. The hospital messed up somehow cause they didnt find anything. But she was close to losing her, the CPS lady was a bitch and was almost trying to find something on her.

you mean if they suspect the mother is abusing drugs while pregnant they can secretly drug test her??

Some states test every baby and some states only test when they think the parent is doing drugs and no they dont have to consent..they took my sisters daughter from her because she was born addicted to herion...but if she was taking xanax and had a medical reason then i dont think it would have been a problem because ive been taking xanax with this pregnancy and with my first one

wow I thought for sure that they had to have consent to test you for anything!!
i am kinda curious to ask my dr about this.. but then again I don't want him to think I have a reason for asking! Lol
