if you have had a divorce

So I am getting a divorce and I have no idea where to start or what to do. So I was wondering if anyone who has had a divorce could help me out a little. What is the first thing I am suppose to do? I live in Illinois by the way and I don't know if it is the same for every state but I read that in order to get divorced you have to be 'seperated' for at least 6 months...Now that is pretty dumb lol. But anyways..please give me as much help and advice as you can! Thank you for any replies!

Go find a lawyer. You can go to the court house and they can give you a llist of free ones or low charging ones if money is an issue. They will get everything going for you.

One of my friends parents just go a divorce and we live in IL and it took a month and they were separated for 1 week

first thing you need to do is get a lawyer. Next, you need to check and see what the requirements are for your state when children are involved. Do you agree on everything? custody...child support...who gets what, etc.
you need to sit down and make a list of all your outstanding debts (most likely, you'll keep paying for yours and he'll pay for his) any bank accounts or other assests you have
I was divorced in Ohio, and there, if you have children, you have to take a "divorce with children class" and you have to live apart for at least 6 months.
our divorce was easy (as far as divorces go) we agreed on everything...we started the process in March of 2007 and the divorce was finalized in august of 2007

well when I decided to get a divorce i went through Kansas Legal services to file. There was no waiting or separation period of anything like that and I signed a form waiving their 150 dollar fee so it was all free for me. She filed it I had to wait till he got served with the papers and then appeared in court. Ours was simple enough and neither of us disagreed or splitting things up or how to handle to children. He didn't even show up to the court date only me   I filed in September and was finally divorced in Jan ... was smoothe simple and sorta fast.

It varies from state to state but in most places you have to be separated for 6 months or more in order to get divorced. In VA it's a year. Divorces can take a long time especially if there is custody, child support issues and also if there are issues of equitable distribution of assets. I had to have one lawyer for my ED and divorce case in NC and a separate lawyer for my custody case in VA. My divorce took over a year but it was somewhat complicated. The fewer assets and the less disagreement the easier it is.

Actually I honestly think that having to be legally seperated for 6 months is a good idea! My ex-husband and I got divorced, thinking it was for the better. We lost our daughter early on in our maiage and a year later lost another pregnancy and couldnt seem to come together and deal, so he left me and filed for divorce. The first step is to talk to a lawyer. He didnt move out of the house til maybe a month before the divoce was finalized... 6months after he moved out, he called saying that divorcing me was the biggest mistake he had ever made and that he was sorry that he didnt try as hard as e should have... Now 1 year after our divorce we are still together, dating and trying to make things work. Having to be legally and physically seperated sounds like a damn good ideabefore allowing a divorce. (Im sure they make exceptions for infidelity or abuse, but im not sure). http://www.divorcesource.com/info/divorcelaws/illinois.shtmlthis should help some.

they had an easy one they didn't go to court yet just the lawyers and her parents well its my cousin's wife parents got to together and talked about who wanted what child and who just wanted what they pretty much agreed that is y it went so fast but her mom filled after being separated for 2 weeks

Thank you ladies for all of your advice. I really appreciate it! Now I kinda have and idea of where to start. And yes we are agreeing on pretty much everything so I am hoping that this will go smoothly and soon be over

I think most states are a year separation unless you can prove abuse/adultrey.... I know SC, WV and VA are. (family members, no I haven't been married 3 times lol)

First, find a lawyer.The paperwork can be confusing, and you don't want to get screwed.

I live in Indiana, and the 6 month waiting period is about the same. Honestly by the time the courts file your papers, you get a hearing and a final day, that 6 months is almost up anyways.

If you are in Cook County, they work like snails on everything.
