Question about child support and visitation

If I take the father of my child to court for child support, will he automatically get visitation rights???

If he is taken to court for child support, that is just what you will get.

Child support & visitations are two different things that are generally seen by two different judges. If he files to get visitation, then chances are he will get them.

The way I understand it, child support is a responsibility, visitation is a right that is pending on what is best for the child. If he is an ok influence on the child, in the courts opinion, he will have the right to visit. If he isn't, he wont, until he complies with whatever the court says he must do. But he has to pay child support whether he visits or not.

unless there's a reason why he shouldn't get visitation, they usually work out a visitation plan then.

hmm...when my sis in law filed for child support they told her he is now entitled to visitation since he's supporting the kid. kinda makes sense to me.

They are entitled to visitation whether they are supporting the child or not. But, if you go to set up child support, visitation generally isn't talked about.

They are two seperate issues in most states. I know when I went through this whole thing last month, I went to two seperate judges, one for each issue.

I went to court almost 3 years ago for child support with my oldest. The visitations where set up as "Agreed on between the two parties". Well I am going back on Wed. to try and have the support increased from $25 per month. I am not sure what will happen, but I do know that visitations will be brought up and I know that he can get regular visits now. I am scared to death! He has not seen her in over a year and he has only seen her maybe 10 times in almost 4 years. I am watching this one. Good Luck!!

yes as long as he wants them or he is proven unfit.

dang. thats crazy. im in cali too and she didnt even see a judge it was the DA i think. and he did the whole child support/visitation thing. he told her that if she wants him to pay then he gets to see the baby on a regular basis

no offense but even if you don't take him, he can take you.....if you withhold visits it'll make you look bad in court unless you believe your daughter will be in harms way but, you have to prove it...
