What can i do? should i be concerned

My brother has a son, and im most concerned about my nephew. Well i havnt seen him since he was around 3 months mind you he's now about to turn 2. She doesnt call to let us know how the baby's doing and she hardly lets my brother see his child. being that my brother does have a record (nothin major) he probaly wouldnt be able to get custody of him but thats not even the point all we ask is to see the baby and at least let him know that he does have another family other than the moms side and we dont want him to think we was never trying to help. Well i called her and invited her to my baby shower and she said she wasnt going to make it becausemy nephew has another party to go to.i didnt mindthat i was like ok but thenshe said the week after he was having a birthday party and i quickly said so you couldnt inviteus, but then she said yea because i dontwant your brother to be there  . i think that is the most decieving thing you could do to someone who wants to be in his sons life.

Is there something i can do to have visitation rights with my nephew or just because my brother has a mark on his record would that make him not be able to see his son. I just dont want my nephew to think that his dad was never trying to be there, When really the mom pushed the dad away .(speaking from experience). Is there any advice to letus know what to do

He should still get visitation. Depending on why he has a record it may be supervised, but he has a right to see his son. Good luck, he should contact a lawyer.

I'm not sure about California but in Ohio the only person who has any legal rights to visitation are the parents. Also in Ohio the other parent is able to get visitation, the amount of time and the enviroment will probably be dependent on his record. If she has any proof that he was abusive to her or the child he can forget for the most part. I would check with a lawyer to be sure about your states laws and regulations.

I do know in Ohio that standard visitation is every other weeked and one day during the week for about three hours. Also every other holiday, half of christmas break and half the summer.

He may only be able to get supervised visits for a while though which would be for an hour monitored by a court offical or cps, until the courts determine he can have more. Worst case they'll revoke his rights, but that is difficult to do.

but she doesnt want him to see or be with his son because he has another girlfriend and im just asuming that if he was to take her to court and they saw that he had something so little as like stealing or something on his record would that be a big problem

If the only thing on his record is stealing and traffic violations it should not be a problem to get visitation. It may be supervised through the courts until a relationship is established, his girlfriend would also have to stay uninvolved in the process for a while. She may cause drama that could hurt his visitation status.

I know with my sons father I can keep him away because I have threatening letters, him calling and threatening me and my sons life and him admitting to abusing me and my child. Even with the death threats and admitted abuse I can not get his rights revoked. I can just keep him away.

oh ok. . .i didnt really think those type of things was a reason to have visitation rights taken away but in some places it probaly does

.so the only way for family to get to see him is through the dad
