My son, Asher, died of a severe birth defect and an incorporation is trying to own the trademark to awareness of this birth defect. Please, help us to stop them from doing this.....
A organization right here in Charlottesville, VA has filed a trademark for ownership of "Congenital Diaphragmatic Hernia Awareness". This means that any other organization or individual wouldn't be allowed to use this phrase or a likeness of it without permission from one person from this organization. This birth defect that took my son, hurts 1600 babies a year in the U.S., kills 800 babies a year... and we're not allowed to raise awareness of it because we might be sued? We can't let this happen. Please help us to stop this.

This is so incredibly important for families affected by CDH and for all diseases and birth defects. If this trademark is granted it will set a precedence and NO ONE SHOULD OWN AWARENESS OF A DISEASE OR DEFECT. Please help us to fight this as this would cause such damage to CHERUBS, CDH families and other CDH organizations. We won't be able to hold awareness events, fundraisers, so many services. We've been threatened by lawsuits for a year about this trademark and it wasn't even filed until April of 2008 - CHERUBS has been raising awareness since 1995. We are appealing this but a petition would greatly help.
We need your help. I am asking personally, in memory of my son,Asher and in honor and memory of all the 1000's of babies affected by and/or lost to CDH. Just a few minutes to sign this petition and forward to family and friends can make such a difference to so many people around the world.
Thank you, from my heart and on behalf of CDH families everywhere,
Kim
UPDATE:
The trademark was passed on the supplemental register (which means that it wasn't strong enough for the regular register and doesn't have nearly as many laws protecting it) so we can still fight it, but they are that much closer to winning... thank you for all your help, and if you haven't yet please go and sign the petition...it only takes a minute!
