help?

ok so my boyfriend wants to adopt my two year old before we get married and she doesnt have a father on her birth certificate. Her real father is in jail for statutory rape because I was 15 and he was 21 and my mother pressed charges.
Does anyone know how we would go about him adopting her?

Depends - every state is different. Up here......The real father of your little one has to sign away his paternal rights, even if he isn't listed on the birth certificate.... unless he is deceased. Paternity has to be established here before anyone can adopt a partners baby.... But the laws in your state are probably different. Check with DSHS.

I looked on their website and it didnt tell me a damn thing lol. I have heard he can just sign the birth certificate but that just doesnt seem very legal to me.

My state also has three ways to establish paternity...

1. Sign an affidavit admitting paternity.
2. DNA test.
3. Marry the mother before baby is born.

So, it is possible for him to just say "I'm the father of this little one," but, dunno about the legality.....

yea it sounds like the only legal way is to get her real father to agree to it and ...since he just served two years... the chances of that are slim

My fiance wants to adopt my oldest daughter. We looked into a lawyer, but we were told you have to be married for at least six months. Thats in the state of Missouri though. I don't know how the laws work where you live.

Once you leave the hospital, and you don't sign the birth certificate within 48 hours of the baby being born, you have to go to the courts to put the father on the birth certificate. I would suggest the family law portion of the courthouse. Go into the self help department and ask them what you have to do! Good luck!

yea I have asked some people at work and I think we have to be married but I dont know how long
