question about child support

well my babys daddy is turing 18 next year and i just wanted to know if i have to put him on child support or cant i make a choice not to if hes helping me out?

Im not sure what the laws are over there.
But in Australia, if the fathers name is on the birthcertificate, they have to pay child support.

I'm a little confused. What do you mean? Is he already paying child support? Do you mean that he must be registered somewhere that he's paying? If that's what you mean, I think it's only necessary if he isn't paying. Otherwise, it's between the two of you (just make sure you keep track of how much he gives you and when - if he gives you cheques, photocopy them. If he gives you cash, maybe keep the deposit receipt from the bank).

You don't HAVE to file for child support unless you apply for some sort of public assistance (Medi-cal, Food Stamps, Tanf)

You can file for child support if you want to but you dont HAVE to. If he's helping you out then just keep it that way.

DHS will only enforce it to come out of his check if you apply for any type of assistance from the state

Totally OT but how do you have 40 days left? I'm due 17 days after you and I have 62 days... that's a 22 day difference... Just wondering.

Yup and then they will want you to file and make him pay for you receiving assistance.

I know this is not exactly revelant to your question but, if he is under 22 i think or 21, he will not be the one paying child support..It will be his legal guardian if you do file. I thought that was the weirdest thing. I just found that out by experience.

that's dumb... I know in WI even if they are 18 they still have to pay not their parents... Once you're an adult it's your responsibility....

Yeah I thought that too, until we (me, my baby father, his momma, n the chick trying to put him on child support)had to go to court and they told his mom that she would be the one responsible for the payments until he was 21 or 22. Oh she was pissed. Maybe that's just MS laws but I don't know.

ETA: luckily the baby wasn't his, so she doesn't have to pay, some other unlucky grandparent of the child will have to pay.
