A crappy morning

My niece and nephew are wards of the state. When they were placed in foster care I was unable to take them. I thought that their mom would clean up her act and do something about getting them back. I realize now that she is all out of second chances. They will be put up for adoption. I don't want to lose them. I love them dearly. So I went over this morning to talk to the woman handling the case. I told her that if they are put up for adoption that Chris and I wanted to adopt them and just incorporate them into my family. I already have 5 kids, what's 2 more, right? She said well were were you6 monthsago when they needed you? I was on bedrest trying to keep myself and my unborn child alive! That isn't fair! Then she said well how about 3 months ago. Where were you then? I was in the NICU with a new baby, unsure of what was going to happen to her. 6 months ago and 3 months ago I wasn't able to take care of my own children, much less 2 more. But there were things preventing it far beyond me. So she tells me that I will probably have to hire a lawyer if I wanted the kids. I can't afford a lawyer! She said that the kids probably won't know who I am now because I haven't seen them in so long. It's been since November because the new foster parents and the DFS system won't LET us see them. I have tried, I swear. I missed my nephews 6th birthday in March and my nieces 5th birthday on the 2nd of this month. They won't even let me send cards. I hate the system. How do I fight it? How do I keep my nephew and niece in my family? I just don't know what to do anymore and it's breaking my heart. If thee is someone with this kind of experience, please help me. I am a desperate woman!

I cried just reading your story... I hope you find what you need to so you can get those kids back. I hate how the system is they should allow you to have contact with them. you're not a bad person you had other things on your plate holding you back from being able to take them. if that lady is seriously that stupid to hold that against you, she's stupid! I'll be praying for you! I really do hope you get the kids!

find a Legal Aid (Lawyers to do Pro Bono work if there is a different name in your area) and see if they can help. You are family and you have first priority here. And you can fight without a lawyer - that woman is BSing you but a lawyer would be helpful.

I am so sorry to hear that. I dont have any idea how any of that works. If there is no reason for you not to adopt them, then they really can't prevent you from doing it. They could be afraid you are just going to give them back to their mom.

The only way out I see, and I hate this, is to find a lawyer that will work, and only get paid if he wins. If your lawyer wins the kids for you, you -could- sue thefoster agencyfor the lawyer fee's for preventing you from adopting family, for no reason.

I don't like that idea, but it would be the only way I know to stand up for yourself. The lawyers will know the law, and if it's not a winnable case, they won't take it.

I, too, would recommend finding a Legal Aid office or someone either willing to take the case pro bono or on contingency. Or you could see if there's a lawyer who's willing to just listen to the situation and will be able to give you advice as to whether or not you'd even have a case or a chance of winning.

I wouldn't dream of giving them back to their mom. I truly cannot stand her. My feelings for her border on hatred. She has had 2 year to straighten up and take care of what needs to be done to get her kids back and instead she has been selfish and awful. Now we may lose them for good and she doesn't seem to care. So she can go to hell. I am adopted. I was born to the most worthless people on earth. Then I wasn't allowed to see my biological family once the adoption went through. I don't want that for Drake and Addy. They deserve better than that. UGH I hate this whole damn situation.

it's not fair that they attacked you for not being there 6 months ago… your there now and they need you… and to tell you they wouldn't recognize you is very cold of her... there is another mother here that is trying to adopted her nephew you could ask her about her experience… there is her link, she is very friendly…

Your right here! Any lawyer should give you a free consultation search around for the best one and if they are good at what they do they will take payments. My lawyer did and he's the best around here, i didnt pay anything until my case was over!!

I am sorry, I dont think it is the situation, but that could be what the agency thinks. That is assuming they are bent on protecting the kids, I don't know them.
