my mom wont let me see my sister at all - my sister is 10 years old and she was so happy about having a niece and being an auntie - i love my sister to death - i know for a fact my mom abuses her because at 13 i got taken away for child abuse. well can i take her to court for vistation or even custody of her?

Yes, you can. As long as you are a legal adult.

You could fight her for custody.

You can bring all that up in court. If your mom looks as bad to them as she does to you, it most likely will be you get custody, and your mom will get visitation. If you can prove your better fit, it's all in your favor. I've never been through it personally but I know plenty people that have.

You would need a lot of proof that she is in an unfit environment.

i am just nervous about all this because my dad has given up trying ( he has trid for 8 years ) because she doesnt give her to him when its his turn and never shows up in court but yet tehy dont punish her

especially if your sister wants out but if you have no proof it will be next to impossible. But since you were taken away that is a plus! (in to your case I mean, thats horrible and I'm sorry your in that situation!)

That's ridiculous, they should. My sister got full custody of Caleb (Brandon had custody) because he was doing that. She wrote down and logged every time she was supposed to have him and didn't. And she saved voicemails and text messages from him saying she wasn't getting him. He got screwed.

You can call the cops, but I know from experiance if it's not going on at that moment, they won't really do anything. They might get DCFS involved and then you might have no chance of getting your sister, Foster care could take her. Unless you stress the fact you want her constantly. I got screwed though, it all happened when I was 17..and they said I was old enough to go out on my own and deal with it. I don't know how a senior in high school is just supposed to pick up and find a place to live, ha.

I hate to say it - but with the courts these days, that may not mean anything. If she (your mom) says that she has changed and you do not have actualy proof - they will most likely leave your sister in her custody. Which totally sucks because it seems like she would be better and happier with you.

Friends of mine were going through a terrible divorce - the mom would never come home to get the kids from the nanny when she was supposed to, she was cheating on her hubby, her kids were always unattended while in her care and would wander off into the nieghborhood, she even let them onto the roof to play because they wanted to (no joke) and the courts would not grant the dad full custody.

I don't know what these courts need to see before opening up their eyes and taking children out of these kind of environments.

Just make sure you document anything and everything that could turn the courts into your favor. You said you can't see your sis - are you able to talk to her? Ask her to write a letter or something to the courts about what is going on.

ETA - Can you ask your mom's neighbors to also document and maybe even call the cops if they hear something going on?
