restrainign orders

im thinking about putting one against my MIL for my son and i, because of somethign she said to me last night, i just want to know what grounds do they normally let u have an avo, she threatened to take my son away form me is that a good enough reason? and i know its gonna cause alot of crap but idont care, she needs to be put in her place, and also if i was to leave the father of my child could i get one against him cuz he has alos threatened to come after me and take my son away...?

Ive been told that you have to be physically threatened by the person.

then ive heard that anyone can apply to get one against anyone, so if you really think you need one or that it will help..do it.

Some states require that person threaten you twice.

If you have used Kaidyn in your threats saying that you will take him away if they don't do whatever it can go really bad against you.

I know that your MIL is a cuntface mole... and things aren't going best for you, You do need to ask permission from Michael before you leave the state as well.

I know you are a fantastic mama and Kaidyn always comes first, You have nothing to worry about.

In all reality I think you need to pack up and leave for a bit until Michael realizes what he is missing out on.

The whole point of an AVO is when you fear for you safety, and that of your child in your case. If your MIL and husband have threatened your or your sons safety then i dont see why they wouldnt do one.

Mel I think it has to havea threat of physical harm for an AVO to stick, I had one against a parent who was going to lay in the carpark under my car and shoot me... she was a park ranger and had access to rifles and was very unstable. It wasclear the reasons why I was awarded one but Kim has threatened kidnapping, I think that thats different.
