How is throwing a newborn in a dumpster "involuntary"?

Kill 2 babies and walk free!
Holly Ashcraft was investigated in 2004 after she showed up at a hospital, post giving birth, with no baby.
She claimed the baby was stillborn and she "disposed of it" herself.
No body was ever found so she was never charged.
In 2005, a homeless man rummaging through a trashcan found a box containing a newborn baby boy.
The now deceased baby boy belonged to Ashcraft.
However since her act of PUTTING A BABY IN A BOX, THEN THROWING INTO A DUMPSTER was "unintentional" or she could not be charged with murder, only "INVOLUNTARY manslaughter".
Ashley walked away with 5 years probation.

Wow, I don't get that either! Seems to me it would be intentional! I don't believe I could accidently put MY son in a box and then in a dumpster. Seems I would want to do that on purpose for it to actually happen!

If I lived in that area I would be petioning for the Judge to be removed from his post. She was a college student at the time-how are we to believe that she did not know a newborn would die if put in a box and placed in a trash dumpster?

She's young. She's white. She's very pretty. She's college educated.

Maybe I'm making assumptions but I have a big feeling the above mentioned are contributions to her walking...

Basically ity explains what really happened. Holly claimed that the baby was stillborn - the prosecution was trying to prove that the baby was born alive and to convict on murder charges. The prosecution didnt have enough evidence so they plead out on a lesser charge. If they would have gone through trial she could have been acquitted all together.

No doubt the girl was wrong, but from a criminal justice stand point there is nothing grossly shocking here.

The last I've heard there was blood in the umbilical cord, which is evidence that the baby's heart was beating after birth.

That doesnt however prove the baby ever took a breath. If the evidence couldnt prove the child WAS in fact alive and breathingthen you cant truely say she did anything. Even with the heart beating she may have thought the child was dead because it wasnt breathing. I do think that she should have told them WHERE the body was when she went to the hospital if she didnt do anything wrong but froma legal stand point atleast she got something.

They suspect that she had a baby before and killed it because a few years ago (I dont feel like looking for the date) she went to the ER and it was obvious she had given birth but there was no baby found. No baby = no evidence.. so there is assumptions there, but no case.

All I know is that she gave birth in '04 and no baby/ body was ever found.
In '05 she gave birth and then put a newborn into a dumpster .
The argument in court is 1) whether the newborn was a stillbirth
2) Whether he was alive at the time of birth 3)If he was alive, would he have suvived had he been given the proper medical care.

Either way, something was up.
Why was this girl not giving birth in a hospital?
Why was she hiding this...two times?
Why didn't she utilize the safe surrender law??

It just upsets me.

I have a "idea" of a few "possible" answers for the last three questions:

Why was this girl not giving birth in a hospital?
If she didnt have insurance then the cost of hospital birth can reach $20,000+

Why was she hiding this...two times?
She did go to hospital so techincally it wasnt "hidden" only the actual bith.

Why didn't she utilize the safe surrender law??
No one even knows how far along she would have been the first time and the one claimed as a stillbirth may not have been breathing so it possibly was thought to be dead.

The fishy part to me though is if she didnt do anything wrong then why didnt she just tell them where the body was?

She didn't get murder because even if the baby was alive, and she did put it in the dumpster, she didn't actually kill it, she neglected it and it died. Not exactly fair in my opinion, butI see how it works. And if she's white, pretty and college educated, there's a very good change that NO ONE in her life would expect her to turn up pregnant and she didn't want to ruin what she was and what people expected of her. Also not right, but I see how that could be why. People freak out. They make bad decisions. Horrible decisions. It is a very sad story though.
