Ok, my mom needs some help and I can't seem to find the right answer on the net...the situation is that my 17 year old brother just got out of the county jail. He is not emancipated, but he can't return home because we have a restraining order and order of protection against him. He is threatening 2 get an attourney or lawyer or w/e and get half of my parents paycheck aka: Child Support....can he do this? and if he were emancipated, wuld my parents have 2 pay him child support?

Ok I dno if Ill be much help
But I know a parent legally cannot kick a minor out of their house
BUT since there is a restraining order then its completely different
If he was emancipated then no, they wouldnt have to do child support
Other than that I cant really help ya
But if he just got out of jail... it doesnt seem like the courts would be helping him out too much
When will he turn 18? He may have to go to foster care?

He won't be 18 until March of 2009

I dont really know an answer to that

That may have something to do with there decision

idk about the first but if hes emancipated that means hes basically getting a "Divorce" from your parents and they dont have to support him whatsoever, if they dont want..

If he doesnt have enough money to support hisself then he deff wont be able to afford a lawyer...
They are EXPENSIVE

and i dont think a kid can sue their parents for child support i think a parent has to sue another parent.. but id call that non emergency number i forgot what it is.. and ask them.

We have a disabled brother, he was in a car accident and has head trauma. He was in a coma for 1 month exactly but still has brain problems. Well my 17 year old brother hit my disabled brother and my disabled brother went into a seizure. So we have a restraining order against him for aggression and stuff like that.

no he cant get child sopport .... im almost positive i meanevery state is diffbut if anything they would put him in foster care so his best bet is to lay low before he gets on the raidar n messes up his own freedom

And Im sure your parents wouldnt be willing to get rid of the restraining order

Dont restraining orders usually mean no contact at all? Like no talking even
So wouldnt he be in violation of that? and if he does try to go somewhere you can use that...

well if he contacts your parents at all saying hes gonna sue you i'd call the cops or whatever cause that IS violating a restraining order.. even if he has someone else tell you for him cause thats a 3rd party violation or something

Have your mom Call your local Legal aid and ask them. And try to let your mom worry about her kids . You've got your own to worry about now. He can't get child support paid to himself though. Child support is paid from a parent to a caretaker.
