Well if the handbook you signed says no smoking on the premesis then you haven't broken any rules. I don't think they can just change their minds and go aghainst what their o own handbook says. Were the other smoking on the property and everyone knew it?

In an right to work state, they can fire for any reason that is non-discriminatory (as in race, gender, sexual orientation, etc). It doesn't have to be in their policy manual. You can come in with a hair color they don't like, and they can let you go. A policy manual just outlines the things you cannot do. It doesn't specify every single thing they can or will fire an employee for.

It doesn't even sound legal to me for them to have that authority, and even if it were I'd partly disagree.

Damn that's sounds so unfair! I look to the handbook as my safety net of things they can and can't fire me for. That's scary that it can be thrown out the window on a whim

It's scarier for an employer to not be able to terminate an employee who's doing a bad job or representing the company poorly. They're in business to make money, not to be nice people.

This has been a big controversy last year. I live in Ohio and if you want to work for the Cleveland Clinic, you cannot be a smoker. They give you a test for a substance found in cigarettes along with a drug test upon getting a job offer. The main reason is that working in an environment with people whose health is compromised, they are more sensitive to cigarette smell, and it can cause negative reactions including migraines in patients. Basically, it has been a major issue with patients, and they decided to just make an all-or-nothing rule. Other states and healthcare companies are adopting the same policy, and they can do so as long as it is considered a negative impact on the company. Now, is there a reason to hire non-smoker IT people who don't deal with patients? Probably not. But as long as they are in the hospital, it's a liability. Good luck with your choice, but I wouldn't recommend continuing lying if they decide to implement the test as well.
