If its assault or whatever, I *think* you can file a report and not press charges. It's always good to have it in an official report, and it may help you in the divorce but unless he has been violent towards his child it probably won't hugely affect his custody rights.

Yes the state can press charges even if you decide not to; it becomes out of your hands. The only instance I've heard of this happening is with assault, ESP domestic, because so often the victim will recant their story.

I assume this varies greatly by state.

Yes the police can most definitely charge someone even if you choose not to press charges. This is especially true for domestic violence cases because so often the victim backs out.

I would file, and when it comes to abuse you don't always make the call of being arrested and charges files agents the other person, if its a man 99% of the time the police will go ahead and charge him. I hope that helps and abuse and being convicted last forever if not convicted I don't think it hold on the record but I could be wrong, good luck and I hope all is ok

   This just happened at my work the other day. This guy was pushing his girlfriend around in the parking lot so we called the cops. She refused to talk to the police so everyone at work had to write extensive reports so they could continue with the charges.

my DH is a police officer. if someone calls the police because of DV, someone is going to jail. it is not worth the risk of leaving everyone at home and later getting the call that the person is dead because the cop didn't take them.
