Child support? UHG!

My daughters medicaid filed a child support case against my husband with the attorney general, texas. I am pissed beyond belief. I have no idea why they would do this. They set up a date for a mutual agreement hearing. My friend told me that I cant just call I have to go to that hearing. She said her friends husband has to pay child support even though they are together and married. My mom told me I could call and cancel it. On my papers it states I can cancel at any time. I plan to call tomorrow but this is just crazy. My friend is being negative about it and my husband is very worried. :/ I am so confused. Can they still take child support from him even though we are married and living together?

That's ridiculous.

If you are married and living together, they shouldn't be able to go after him for child support.

I would get a lawyer and encourage you both not to sign anything.

If you are married, why is he paying child support? That is silly. I wonder if it is because he wasn't listed on the initial paperwork as being married or living together. There could also be a glitch. Don't stress. They go after the partners for CS because they need to recover some $$ somehow. Medicaid is after all a welfare program not an insurance that you purchase thru an agency.

My guess is that there is a cross in paperwork and I would just do the best you can to get thru to the office with all the supporting info you need to prove you are married and live together. Keep calm and try not to stress. It will be ok.

That is what I am thinking. He is on the paperwork with medicaid. Listed as my husband and his income. I will call the Attorney General tomorrow AND medicaid to get this sorted out.

they can take him for child support if you are asking for help in the welfare system doesnt matter if your married or not it doesnt really matter anyways the money will come back to you in one form or another

Me either, this is why I am confused.
If they do I know that the money is coming back to us but it still bothers me that they can do this without my permission.

They can do it if you aren't married....but, I've never heard about it happening with married couples.

No they can't   Not if he is listed on the paperwork properly and his income is included. What are they going to do? Squeeze blood out of a turnip? If he wasn't listed properly, then they can. If they weren't married at the time of application and she didn't amend her file, sure. Just not if everything is done properly. By taking child support they are opening the door for them to need other forms of assistance. See the pattern and cycle it would create?

we got married the weekend before the child support hearing and i called them the day before the hearing and said we got married so they cancelled it b/c they won't take him to court for child support if we were married and living together.

We have been using medicaid on our daughter for 2 years. First year was because I was pregnant. I am now currently using it again for pregnancy. Not my first choice but my husbands job offers an extremely high priced insurance we just cant afford. Everything on my case is perfect and nothing is wrong.

I called the attorney general today. She told me that we HAVE to go to this negotiating hearing. I can tell them I don't want child support but the reason why they did this was because they are starting to have people pay back medicaid. Well at least us. She said even though they will cancel the case he will still have to pay a fee for having medicaid. Which is weird but whatever. We are thinking of switching to CHIPS for our children. You pay a small fee and still get medical insurance. This is ridiculous. None of my friends who are married and have medicaid have to go through this.

I kept telling the lady we are married and living together. She just said we still have to go to this hearing. :/
