No, you can't take the child out of state without the mother's permission....just like she can't take the child out of the state without the father's permission.

Go to court, get custody sorted, then go on vacation.

Are you just crossing one state line? I know here we have 4 states that are all very close so it's not an issue when it comes to custody. If she's just a pain and it's only one state, I wouldn't mention it. But if you're flying across the country, that's a different story.

Does it sound like I'm joking? Not everyone lives in the very center of a state. Here, we cross state lines on a daily basis so yes, laws do vary state to state believe it or not.

we'd cross a few states, she's just a huge pain in the ass, and constantly finds something to bitch about, she has yet to grow up and realize what is best for her child and not just try and do everything she can to screw my SO over

yea i know what you mean, we live right on the border to 3 states, so we cross into those quite often, but never really think of it as a big deal since it's never for more then minutes or a few hours

Has your SO filed for custody and visitation? If not, she is not screwing him over.

In Ohio, the mother has sole legal and physical custody unless the father's rights are established by the courts.

Eh well that's a different story then. If you have the time, I would try and get custody sorted out now but I know how long it takes the courts. If that doesn't pan out, I would definitely mention it to her soon so she can warm up to the idea instead of springing it on her last minute.

yes he filed for shared parenting, since they where already pretty much doing that, and then she got all pissed at him for a bunch of stupid smurf and then wouldn't agree to it in court, so the court just gave him 50% visitation time, but gave her full custody

yea he's about to get a lawyer and file for joint custody, we're just waiting on our tax money to get here

So, they have joint physical custody and she has sole legal custody? That doesn't make a lot of sense.

As long as it is not going into her time with the children, I would just let her know in writing as a courtesy that the child is leaving the state.
