How would that even be murder? Negligence, maybe manslaughter. But isn't murder supposed to be premeditated?

First of all, unless this is out of the US, I don't really believe it.

BUT, if it is true... no, I don't think this woman has grounds to sue. She knew how far along she was and she still chose to terminate her pregnancy. The abortion was HER choice, not the clinics. She probably did deliver the baby alive, but it was probably dead almost instantly. A baby THAT premature can not breathe on it's own. It would have died within minutes. After it passed, what else are they going to do with it? I highly doubt anyone going in and getting a late term abortion done wants to keep their fetus and have a funeral. Obviously the baby's life had little meaning to the mother.

I thought it wasn't legal to have an abortion at 20-something weeks in the states? Also, if the baby was 23 weeks it would need a birth cert and to be properly disposed of or the doc could get done for improper disposal/mistreatment of human remains. This sounds like crap to me.

i googled and nothing comes up about it.

however, i don't see how it would be murder if she signed paperwork to have her pregnancy terminated. i know nothing about abortion though so that is my uneducated opinion.

Not really...
I mean, if the late-term abortion was legal... it was the mother's choice. I'm sure in a clinic, they don't have the means to resuscitate a baby. If a baby was born THAT premature, even if it took a breath outside of the womb, it would be unable to "breathe" independently on it's own. It would die within minutes of essentially suffocation. It's not the doctor's fault if they did not have the means to save the child.

I'm sure the baby died almost instantly.... and what were they supposed to do with the fetus after it had passed? Wrap it up in gift wrap?

However, I do agree with the doctor being a murderer. I think ANY doctor willing to perform an abortion that late in pregnancy is a murderer. It's sick.

Yeah, we do late term abortions in some states.
There are plenty of valid reasons why they're done.

It was probably placed in the biohazard bag and put into a special container to be disposed of properly. The mother probably construed this as "throwing it in the trash." I HIGHLY doubt this was done anywhere in the states because I don't believe late term abortions are legal here.
