Any one in Texas used the Attorney general

To establish paternity but not to collect child support? Back story is I left my husband and we were in the process of getting a divorce. Well I started a relationship with my SO now and ended up pregnant and in texas they wont grant a divorce while the wife is pregnant. My SO signed the acknowledgement of paternity and supposedly my husband signed the denial of paternity but the vital statistics has no record of it. My dd is now a year old and my husband will not go to resign the paper like he needs to. So I want to get a dna test done through the attorney general to establish that so is her legal father because as it stands the husband is considered the father since we are married. I dont want them to take child support from so because we live together he already supports us so that would be stupid. So has anyone done this before? Will they take CS from so even if we are living together? Or if any mommas have been through a similar situation what did you do? Im so lost please need help

I only used the OAG to setup child support, but I know they do have this form https://www.oag.state.tx.us/cs/forms/form1608.pdf maybe you can just use that and go from there, or call the OAG office and find out what they think you should do.

Why does it matter if it goes back to you both anyway?

Yes, because they generally keep a small portion of it to offset the cost of the Paternity test.

I have a good friend that works for the attorney general in Austin that I've known for about 8+ years I can pm you her name and maybe call and see if she's available to talk to tomorrow if you wanted

Because they charge a fee for using their services. I know it comes bck to me but its pointless to have that done.

I talked to a rep for the attorney general and she told me they would help but it would open a cs case if i go that route im just hopping they decide to not take it from so since we do live together.

Yeah, I'm sure if you explain to them the situation or see if you guys can schedule an appt and go down together it might help. My ex was the same way, except he didn't want to pay Cs at all.

I kind of figure if I do it this way we will have a court date to determine everything or a mediation date and maybe then I can explain to them I just need it to establish legal paternity and they wont try to do cs but so said if they need to its fine b/c it will be coming right back to me. I dont know the whole situation is screwed up. Just wish my ex wasnt such an ass and would just do what needs to be done its just a piece of paper and will take 5 min tops.
