another custody question

if the father of a child didnt know about said child until it was 3 months old, didnt get a dna test done until 5 months old and took the mother to court for shared parenting can the mother claim that the father has abandoned the child or is she full of smurf and should expect the judge to think the same?

She is totally full of smurf.

He went a d got a DNA test and filed for custody after he found out about the baby. No one was abandoned.

yep...abandonment means no contact no nothing or what contact is given is stating that he wants nothing to do with baby a dna test and custody kinda throws that out the window lol

she also claims shes gonna get his rights taken away even though hes not unfit at all. also she said shes going to avoid going to her home so that he cant find her, pretty much kidnapping the kid

She keeps that up and things could really go in favor of him. Why wont she let her childs father have contact exactly?

she told him she miscarried so he lost her number and then she showed up when the kid was 3 months old claiming hes the dad. she forgot his last name.

Most of the time the courts will not strip the parents rights unless it can be proven that they are physically or mentally abusive to the child.
And she can get in trouble for keeping that child away from the father.
Does he have texts or messages where she said this?

she claims he got her pregnant on purpose and it pissed her off. she wants to leave state and if hes the dad he doesnt want that to happen so that pissed her off too. she wants to be in complete control of the kid and doesnt want him to do anything but pay child support

he would never harm a child. i have a daughter with him and i have 3 sons from a previous marriage that he loves and would never harm them. she said shes taking the kid out of state and theres nothing he can do about it, she thinks the judge will let her do what she wants. yes i have every message shes ever sent saved

Yea well it doesnt work that way sadly. She needs to get over the past and they need to figure out how to co-parent and do whats in the best interest of the child. He can go to court and fight her moving out of state and get visitation. If he wants to be involved and is a fit parent then he will be involved.

hes tried to be civil. the results arent back on the dna test and shes pissed because he wont go see the kid.
