Apartment noise...

About a week ago our down stairs neighbor's boyfriend walked around a little before 8pm and gave DH a dirty look, didn't say a word, went back inside and slammed the door behind himself.

I was thinking that maybe he was upset by the noise from us laughing at the dinner table and DS playing in the tub afterwards.

Well today, at 5pm, my neighbor, the woman, knocked on my door and politely told me that DS was making too much noise. I apologized to her and explained that it's something that we're working on with him. DS is 3 and will run at times or stomp. It isn't a constant, but he does make noise.

So when DH came home from work I told him about the incident and he immediately got upset because I told him, prior to today, that I think he was imagining the guy giving him dirty looks, since DH said it's happened more than just that time. Then DH was like well what now? and I was like I'm not sure, I guess we just need to continue like we are with correcting DS. Which then DH started bitching about how we need to look into getting a new place and blah, blah, blah even though we just renewed our lease.  

DH thinks that they're eventually going to complain to the office, since the guy down stairs gives him dirty looks, and we're going to get in trouble about the noise. But we can't, can we? Like I said, I know DS can be loud at times, but it isn't anything super crazy and it's during normal hours. I could see if we were making noise at like midnight, but DS is in bed by 9, and settled down at around 8.

I really don't want this to become an issue because we're legitimately trying to keep DS from running and making loud noises.

You should check their policy about noise complaints.

Is there a time where everything needs to be quiet?

Is there a limit of complaints before they take action?

That's not enough to call the police over so I wouldn't even worry about it. Kids stomp , oh well.

Y'all are lucky to have neighbors who tell you, and don't just report. They didn't have to do that.

That being said, it's annoying to feel like you have to tip toe through your own home.

Call your front office and talk to them about what's going on and ask them if you're in any danger of "getting in trouble".

While signing the new lease I did see that the noise curfew is 10pm, but other than that I didn't see anything about noise complaints or complaints/strikes until action is taken.

I don't think you can get in trouble for your son making noise during normal hours.. I think if they can't stand hearing anything from a neighboring apartment they should live in house with no neighbors. What if you had a baby with colic that they could hear scream throughout the night? Would they expect you to move because they didn't like the noise?... I would make more noise during the day just to piss them off more.

Then I'd call up front and just explain the situation so they're aware.

Well I'm definitely not going to make more noise just to piss them off. I've never had an issue with any of my neighbors before this. When we first moved in I always told her to let me know if we were too loud because I know every day noise inside of our apartment sounds different when you're living below. We've lived here for a year and she has always told me that it isn't a big deal, I have a kid, and she's rarely home anyhow. But ever since this guy moved in the issues have began. I'm not saying that we're saints, just what I've noticed.

I'm trying to avoid being a problem, so I don't want to become a bigger one. I like where we live. I just want to make sure that if our efforts aren't enough if we could possibly lose our place over DS being a toddler.

I need to run up there soon to drop off our renewed renter's insurance so I'll explain it then. I just really hope this doesn't escalate into something bigger.

I understand apartments suck. That's why I basically forced my husband to move into this tiny ass house that we are in. I was sick of hearing every time my neighbor sneezed. He lived alone so he never spoke, but I know he heard every convo my husband and I had. And every time we had sex. It was creepy and gross feeling. But I couldn't imagine someone telling me to make my child stop being a kid.

Maybe you could talk to the office and see if they have a downstairs apartment available? I would go mad if I had to tell my kids not to stomp/run, it would be a never ending battle. Lol. The best situation in an apartment with young kids is to get a downstairs apartment and hope to God your upstairs neighbors don't have kids, lol. And some apartments do have rules about a certain amount of noise complaints. Check with the office about their rules on it.

I know, my husband is pissed about it. I think he's more pissed off about the guy giving him dirty looks than her complaining, honestly. I can't blame him, it's annoying. I'm glad she came to me first, though.

The thing that sucks is that we're not in the position to buy right now, with DH's credit, and we just renewed our lease last week.  

This is just more motivation to get DH's credit in order before this new lease is up.

It really is a never ending battle! I was thinking about asking for a downstairs if one is available, but I really don't want to move all of our stuff again. Of course I don't want to deal with complaint after complaint, either. Idk, this blows.

are there any rent houses that are in the price range you pay now? The house we are in was a sell by owner but it was only $35,000. So my mom purchased it and we make the payments which are only $225.00 a month plus our utilities. Every thing balances out where we are paying right around what we were paying for our apartment that had everything included in it.

Nope. We pay $850 a month on a special, if it weren't for the special we'd pay $1150.

I actually looked at a few houses before we had to put in our 60 days notice if we didn't want to renew and there isn't a house for rent that I could find, in our area, that is less than $1,200 a month.

that sucks   but honestly as long as you aren't having noise issues after the time in the lease there isn't much the tenants below you can do about it. They should have known what apartment living was like before moving in.

And what sucks is I just looked and found a house for $800, it was just added today. Really? Why couldn't you be there before we signed on for another freaking year?! Ugh. It's probably not even legit anyhow because it looks way too nice to only be $800 when houses similar are running for $1,600.

Oh well. I'm just going to talk to the front office, explain the issues, and continue on with our efforts. I just need to keep in mind that it's only one more year, lol.
