Military wives/SO's- Question.

Friend of mine's husband claimed to his wife he was discharged 2 years ago. Since then they have been living normal civilian life 3 1/2 hours away from base because- of course he was discharged. Well he was taken today because come to find out he hid from his wife he was really AWOL. He was never discharged. What kind of punishment could he be looking at? Google is super confusing on the topic.

It's a slippery slope between AWOL and Desertion, it's going to be up to the military to pick one...AWOL is less severe but can still carry a prison sentence, desertion the max is death. But highly doubt it will go that route.

I honestly have no idea. I just hear irs a long time. 30 years in jail from some stories ive heard but it depends in the circumstances.

Well this isnt good anyway you look at it. Depending on what they charge him with at the least hes looking at time in the Brig.

Yeah it's definitely no good. On a personal note she is (i feel stupidly) planning to hire an attorney and attempt to fight it. I don't know how she plans to fight it. He was either discharged from the military or he wasn't. And the military seems to think that he has been missing the last 2 years. The other thing is- hello! Your husband chose to keep a major secret from you for the last 2 years that held hefty jail time. But to each their own I guess because she doesn't have any ill feelings towards him for hiding it from her. She is ex military too so idk what she thinks she can do.

Legal isnt going to help in this case, its just going to eat up any money they have and draw things out.

If she is financially dependent on him in any way shape or form, she needs to save money not waste it.

She's definitely depended on him. She already has some fairly large health issues and 2 kids with him.

I know she just recently had to stop working because of health issues. I know he's been working but have no idea what kind of jobs. So maybe it was under the table?
