Child Support--what if Ex-Husband lost his job?

It’s a big coincidence that my soon to be Ex husband “lost” his job or got fired the weekend I was going to leave him. 12 Years at his job ( a very good one) and BAM its gone. He always use to say that he would move out of state and quit his job if I ever tried to pull the ex-wife thing. I am curious, do I still get child support? He had a 401k and pension, but his 401k wasn’t much. His salary was great, but now he doesn’t have any, just Unemployment. Do my children still get a decent amount of money?
PS yes he is a smurfing D bag coward.

You re-file with his new income. They will base it off of that. When he gets a new job, you will refile and have it based off of THAT income.

It's a percentage of income. The lower the income, the less child support will be.

Assuming he lost his job on purpose is a bit much. If he wanted to quit, he's have quit. He's getting unemployment so he was let go. He probably wasn't "fired" because they generally give you the option to "quit" so it's not on your record. So my guess is that he was "laid off".

If you were laid off and paying child support, how pissed would you be if you still had to pay the same amount when you can't even afford your own rent and food? He sill needs to survive while providing for his kids while he looks for a new job.

Oh cool, thanks for the tip.

They gave him three warnings. It was all over tardies. Who the hell gets tardys going to work at 2PM?! It was always unexusable for me but its like he didnt care anymore. I really needed him to be responsible and I just got tired of it. Not to mention His abusive ways. He cost me my job because he wanted to argue all the time and made me late to work purposely. It was a bad marriage.

Well it's over now and not your problem anymore. Just file for child support adjustment with his unemployment with a note that it will be refiled when he gets a new job. I would leave the rest out, they're not going to be interested.

My ex husband is considered a "seasonal" worker, he's a roofer, so from Oct- March he is laid off every season. He gets unemployment and still pays the same amount in CS. He has been to court twice to have it adjusted but the court told him to get a job during the off season. Most of the time the court doesn't care that he is unemployed the CS comes out first from his unemployment payment.

Finally, a woman who gets it. I thought I was the only one. Yes, some men just don't want to pay, but some women think they are entitled to the world. My brother was working two jobs to keep his bitch ex-wife happy. She started going to the gym and got in great shape. She also got a boyfriend who worked out in the same gym. He was much better off and made more in his one income that my brother made in his two incomes. Still, she took him to the cleaners and he had to pay child support on both jobs. So when he met a woman he liked, he took on a third job. He seriously works a lot of hours. Well guess what? The bitch decided she was entitled to part of that income also. So he pays child support off of three jobs.

It's not like she needs it either. Truth is, she could get along just fine with no child support. In fact, if she was a good mother, she would allow him to do as he suggested, which is put the money in the bank for the two girls to go to college on later. Why not? She does not NEED the money. She wants it to keep herself in nice clothes and that new BMW her husband bought her.

The truth is, many men have to live crappy lives until their children are grown. The stereotype is some business exec who makes 6 figures and lives high on the hog while the kids and ex go hungry, but the truth is, most men give up a significant portion of their income and have to move in with friends or family. At a minimum, they have to do this until all debt is liquidated so that what little they retain, they can live off of.

Many, but not all of these women already have boyfriends that they move in with, or marry withing a few years after their divorce. So they have her income, his income and the child support. It doesn't take a rocket scientist to realize that if the woman does have a new SO who has a decent income, her standard of living improves greatly.

Child support isn't about the other parent NEEDING it. It's about providing for your share of the life you created.

True, but if the mother doesn't need the money, the child is better served having her college paid for so that when he/she is ready to go to school, it is already paid for.

Seriously, I have a friend does not need the money, but what does she do? She uses the money to live high on the hog, and buys the kids toys they don't need. I mean sheesh, the oldest boy has pinball machines and arcade video games in his room. About 6 of them It's a huge bedroom too.

Guess what she is not doing with the money? That's right. Paying for college. Her grand plan? Send the kids to dad to ask for the money when the time comes. Its the epitome of selfishness.

The custodial parent can save that money for college then.

Let me assure you that NO child support amount is enough for someone to live "high on the hog".

You would be wrong. My friend married a contractor who builds houses. She has zero need for a single dime that she children's dad pays. And how much does he pay since it is for 3 kids? A little over a grand a month. About $1200. He has to live with his parents. She is a bit of a bitch too. She always sends the kids to him for everything they want, such as bicycles. He is very sweet and never says no to his kids.

A point you are missing is that no anount of money is ever enough, but many of my friends who receive child supporr do nothing but bitch about it and yet because they are remarried, or have live in boyfriends, their financial situation is better than when they were married. Even the ones who married men who were no better off than their ex husbands. DO the math.

Make it easy. If he makes $3,000 a month, and she makes $2,000 a month, then they divorce and she ends up with another guy who makes $3,000 a month, plus has $1,200 a month child support, her household income went from $5,000 to $6,200.
