Can the judge make me move back to MN?

I moved to Arkansas right before Christmas last year. I have court on April 24th for custody of my son which I didn't find out about until after I moved.

Can the judge make me move back to Minnesota? I mean, I have a job here in AR, an apartment with a 12 month lease, my autistic son is in programs and even if he weren't, all that moving around isn't good for him, he needs stability and structure (which I will be bringing up in court as one of the many reasons why BD should be granted no custody), and if I did move back to MN, I'd have nowhere to, ya know, live.

So can a judge make me move back?

I don't think so. That would be overreaching. I thought all they could do is make the person who moved away provide transportation arrangements to give the other parent visitation.

No, but the judge can make your child move back.

This is why you ALWAYS get permission from the courts or your ex before moving states or provinces.

Make sure you have proof that living there would be better for him. Like copies of the reports from the specialist etc etc...

What if the other parent has a history of drug use and violence? And hasnt really been in the child's life for the last two years? Then probably not, right?

This.
My mother tried to move us all to Missouri when we were kids. The courts gave her two options - move back or give custody to my dad. There was no legal way for her to stay in Missouri, with us, without his permission.

They didn't make me move back to TN.
BD never paid child support and has no family in TN and a history of arrests.
I moved to TX, better economy and family to help. But now I can't leave TX, unless I have his permission, no worries there though.

Even if I have assumed sole legal custody to the child? Since we were never married.

I moved out of state without getting permission. We don't have a parenting plan or custody agreement so I didn't have anything in writing saying I couldn't. I figured he was abusive, selling drugs, and hadn't seen my kids in 2 years.

OP- you'll probably just have to provide transportation halfway to MN for visitation.

I don't know how it is there, but my mom just got done with her custody battle. She was told she's lucky that she's been here for over a year and that her kids are in school and have new friends.

I'm trying to get the judge to see that visitation would not be healthy for my son since he is autistic.

Anything could happen.

Best case scenario - the judge agrees with you that moving was best for your child and you will have to split travel expenses for visitation.
Worst case scenario - court is dragged out and the child is forced to be returned to the state.

is the drug abuse and violence documented through the police department?

And OP, I don't have to pay a dime towards visitation. The judge told him to use his 3 years of child support he owes me towards it. Lmao. They told him it's up to him to see her, I can't prevent it, which I don't, and he has to make sure it works with our schedule.
They also told me if he continues to be late or completely delinquent on his CS and he can't prove HE flew/drove down here on his own minimum 4 times a year, when she is four I will be granted full legal custody if I filed (already have full physical). So far, she is 3, he can't prove it.
