re: Can the judge make me move back to MN?

I've got one police report from our relationship and I have a facebook message where he admits to the drug use during the relationship plus pictured of text messages from his phone that prove he was selling and using after the relationship. I also have pictures of his apartment that support my claim that its not a healthy environment.

And I'm assuming that your children's father didn't apply for custody, thus your situation has nothing in common with this one.

I doubt it. In MN the father has zero rights until established in court, even if he signed the ROP and BC so you didn't have to ask the courts and him before moving.

Obviously, it would have made things easier in the long run because now she has to return to her home state for court for who knows how long.

He knew I was moving. And I don't even know if I could've asked the courts because right after we broke up, I tried to file for custody but they said I couldn't because I already have it by default.

Well, he is within his legal right to file for custody.

When you do go to court, instead of slagging him, focus on why the move was best for your child.

Also, don't get your hopes up about no visitation. It is very unlikely that he won't get any.

You can't file for custody when you already have it. It doesn't work that way here. The case should be moved to her state since she's been there for over 6 months. It's not even a MN problem anymore. I'm surprised they haven't moved it already.

I know he is; I've been trying to get him to file for two years.

I'm going to focus on everything.

Even if it is unlikely, I still have to try. If he has to have visitation, I'd rather it be supervised.

is your court in MN? I hate to tell you.. but judges here are VERY pro 50/50. what does dad want? my ex had an open CPS case against him.. he got 50% custody and I cannot move more than 35 miles away. The kids school counselor told me they knew I was what was best... but they woudlnt' bother going to court with me because even druggies were getting 50% custody. MN is trying to pass a law where every father gets 50% custody automatically unless they waive it. : /

!!! Op... see if you can get it moved. If you can avoid it.. do NOT go to court in MN.

They were very on the mother's side for me. He barely got any visitation. Like 15 hours I think and he has no reason to get so little. The judge in the county I work for is the same way. I'm pretty sure it depends on the county, but anyone I know here has always been favored as a mother. You must have had hard judge.

A few issues with this:

1. If you've claimed that you were the victim of domestic violence, you can not be a supervisor for visitation.

2. Do you not work? Long distance visitation plans usually end up with pre-school aged child going to the other parent's house for several days in a row 3 or 4 times a year, plus major holidays.
