ALVIN, Texas -- Officials say an arrest has been made in the shooting death of the driver who killed two young boys in an accident in December.
Authorities said that a 2000 Chevrolet Malibu passenger car crashed into the rear of the pickup. David Barajas suffered non-life threatening injuries while one of his sons, 12-year-old David Barajas died at the scene. The other son, 11-year-old Caleb Barajas was airlifted to a hospital where he later died.
The driver of the passenger car, 20-year-old Jose Banda, which crashed into the family's pickup truck was found with a single gunshot wound to the head. He was also airlifted to a hospital where he later died.
Officials said Banda was intoxicated at the time of the crash. His Blood Alcohol Concentration was .175.

What would you do in this situation, if it were your children? Do you think the father should be charged and punished to the full extent or face a lesser charge/punishment?

Its not his place to play judge and jury. I fully believe he was in the wrong to take that mans life.

He shouldn't have done it. But I can't say that I wouldn't do the same. I'm not sure what they are charging him with, but I would say that voluntary manslaughter should suffice.

I agree. Especially knowing that the driver was drunk. He was lucky that the driver took off and he was able to find him. He should have given the police his info and let them handle it.

As much as I would want to do that probably too, no i don't think it's right. He should have the right to be tried by law, not murdered.

I would want to beat the ever-loving smurf out of him, but I'd let the justice system handle it. Now that family has lost two children and their father.

It would take a lot of circumstances for me to turn a blind eye to forms of vigilante justice. Maybe, maybe if that kid had done that multiple times and our justice system continued to fail, but it wasn't even given a chance to work... And it's a big maybe in that situation.

I am sure I would have beat the crap out of him but never murder. Also how did the father have non-life threatening injuries but both of his kids died? Were they buckled in correctly?

Understandable, yes. Justifiable, no. I'm sure we all have empathy for him and would probably want to do the same in his position, but evenlegalities aside, they say "an eye for an eye leaves us all blind" for a reason. Sad story, no one wins in these cases. All the families must be devastated.

Crime of passion. He shouldn't be sent to prison over it. If anything he should get probation & community service.

From what I understand, the father and sons were pushing the disabled vehicle and the guy ran into them. They weren't in the truck.

I've seen plenty of cases of first time drunk drivers killing someone and multiple drunk driving offenses and the person walked out of jail in less than a year. That man lost 2 kids because of an under aged man was so drunk that he crashed into their vehicle. I would have been so enraged and upset that I'd probably do something to the driver. I wouldn't have gone home, got a gun and go back to the scene and kill them but I'd be sure to hurt them and make them feel my pain. My friend passed away on Wednesday in her sleep (she was 70) and I was shaking and crying so hard I couldn't think of anything but OMG SHE'S GONE. I was freaking out. I could see someone being so freaked out and upset that they would do this. I say he is justified.
