THAT SON OF A BITCH! VENT

So please excuse this vent.... My ex husband, who was abusive and shook our son, left my son and I homeless with no money after clearing out our bank account etc... you get the point. He's a low life yada yada...

This smurfer pays child support every 119 days! ARE YOU SmUrfING SERIOUS!?!?!?!?! Ok, now let me explain. After 120 days they put a warrant out for his arrest... so every 119 (I count b/c I want his ass in jail) he pays... a TINY amount, just enough to stay out of jail. He doesn't call, send gifts for christmas or birthdays.. hasn't seen my son since he was 1 (hes 5 next month). They garnished his wages for non payment, so he quit he job and gets paid under the table. He doesn't file taxes so I can't get his refund. AND THIS JACKASS won't sign over his rights so my husband can adopt him. I am INFURIATED! And what gets me the most is my son is autistic. He requires all sorts of therapy etc, and he doen't help in anyway ... which would be fine if he just signed over his rights and walked away... BUT NOOOO... he won't. Instead he makes SERIOUS cash under the table and spends it on drugs and alcohol and doesn't want anything to do with his kid... which is a good thing... but STILL... just sign the damn rights over or pay up.. PERIOD!

This worthless piece of smurf... ugh I just wish he'd smurfing disappear! Every smurfing time I get to 119 days I get SO STOKED that I can finally put him away, but then... magically I get a small ass payment. I can only think his parents pay it so he stays out of jail. This is just UGH! I wish there was some way for the courts to see that he is only paying on the 119th day so he doesn't go to jail. I would just really like for a Judge to see through his smurf and strip his rights.

Does anyone know of anything I can do? I'm at wits end.

Why the hell doesn't he just sigh his rights over? Does he think it'll make him look bad or something? Hell maybe his parents encourage him not to. Do they even see their grandson?

Have you tried going to court to have his rights stripped?

I would take him to court to get soul custody. I wouldn't deal with that smurf.

While I understand your frustration, it still is his son by blood, even if he is a smurffy father. Your husband is not the child's father and giving your child up for legal adoption to another person isn't something to snuff at.

I would THINK that since he shook your son and hasn't seen him in almost 4 years, that would be reason to terminate rights, no? If your husband is willing to adopt him.

That doesn't matter. Any man can "donate" sperm to make a child. If they aren't involved in the child's life or paying then they aren't a father. If she has a husband who is involved in her sons life and takes care of him financially then HE is more of a father to this child. The deadbeat obviously wants nothing to do with the child.

Edit: being blood doesn't mean a damn thing when you have nothing to do with your child so if the husband wants to adopt him oh well.

Id be infuriated as well. I hope you can do something about it, have you guys talked to a lawyer, and see if there is anything you can do about the situation?
