baby's dad trying to take him

my baby's father is trying to take my son because we didnt end up moving into an apartment so he got mad at me and threatened to take my son away from me for not wanting to move. can he do that if he is on the birth certificate? he has no job, no where else to go besides my house where i pay all bills and pay for all of my son's needs. could he win in court? i didnt think he could, but im just nervous ill come home and my son and him will be gone..

He can take him. Are you two still together?

I think it is really hard to get a child away from the mother. I doubt a judge would take your child from you unless you are deemed unfit. Being the child's father, he could get shared custody or visitations. But I doubt you would lose full custody of your child.

technically, yes, but we are unmarried we just live together basicly.

I don't see how he could win in court.

If there is no custody agreement then yes. If he is threating it I would not let him have the child alone till a court ordered custody agreement is made.

I doubt it and he has no job or place to live. I'm sure they wouldn't take him from you maybe he would get partial custody but still not in his current situation.

If there are no court papers in place then yes he could take him.
I am no way involved in the law of USA, I do live in Austraila, here in Austraila they look at the child well beign and more secure, they also do shared parental rights so if there are things like that in USA he may end up with something like that?

First step is kicking him out of your house. I would never stay with someone who threatened to take my child away. Second step is to put your LO in daycare or have a family member watch him. Tell them under no cercumstances is he to pick up your LO. Do not give him unsupervised visited until you file court documents to get child support and custody arrangements.

he;s on the birth certificate he has rights and he can just up and leave with him ...i wouldnt leave him alone with him untill you go to court and get some sort of custody agreement and he wont win in court especially if he has no job or house or isnt in school etc

If you want to make sure that he doesn't you need to go file for Ex-parte custody the first to file this will get the child until the temporary custody in almost all cases

If you are afraid that he is going to do that you can get emergency temporary custody until there is a custody hearing. I don't know much about it or how it works.. Good Luck.
