most of this happens in the lunchroom. (there are 7 people (lunchroom staff) and a security guard for 288 5 year olds.

If it were me and I felt that I had exhausted the schools chain of command (which it sounds like you have) I would make sure I have everything carefully documented- bulling instances, phone calls to teachers, princepal's super intendents etc and get some advice from a lawyer or maybe call my local news station..(maybe that is a bit extreme, but what else can you do)..you know they just love a story of a public school not protecting the interests of your child. I'm sorry to hear school is so rough for a 5y/o . What type of bullying is taking place?

hitting..biting..hair pulling..scratching. name calling.

even the teacher said she has never seen such vicious behavior for 5 year olds

If the school does nothing about it, you do what you need to do. We moved and my daughter started at a new school in November 2011. She absolutely hated it and was picked on by the kids in her class. When the school year ended, we gave her the option of transferring back into her old school and she took it. You don't even want to know how much gas I use to drive her and her sister back and forth every day. I drive them 32 miles a day to make sure she goes to a school where she is comfortable and enjoys attending.

It's an absolute pain in the ass and hard on our already limited checking account but their education is important.

is she doing well in her old school?

my daughter means the world to me and to see her cry every morning when we walk into the building breaks my heart.

i wanted to punch her teacher in the face today. She didnt want to go into her classroom so I had the teacher come out and talk to her about how they arent going to pick on her anymore. and she still said "No..Mommy i want to go home. I dont like school!" and the teacher said "ugh.. i dont have time for this. I have a class to teach "in a snotty attitude and rolled her eyes. like real nice attitude lady.. its YOUR class that she hates!

Very much so. She's the queen bee of her age group (4k-1st are on this playground) but she's nice and includes everyone that wants to join her and her peers follow suit. She likes to make sure everyone is nice to everyone else.  

However, since she attends a school district where the graduating class has never reached 100 students, she has an advantage since the class sizes are small and the student body is small.

that is why i want to move out of nyc. she has 288 other kindergartners in her grade. It is crazy how they jam that many students into one grade.

the HS that I went to had 6700 students in the entire school for a school that is only suppose to hold 5000
