What scared me about OP's story was how he said he was going to call the cops because he wasn't getting his way. So then maybe she would have to leave the kids there and not get them back until they went to court to settle it.
They need to sit down and talk it out like adults or take it to the courts to make the decisions for them.
If Dh and I were separated I would freak out if he kept trying to change times on me and then threatened to call the cops.

He wasn't going to call the cops. No one did anything. He was seeing how easily she would back off, since being an adult hasn't been working.

Pretty sure if you read and understood the story... she said in there that she has accomodated to what worked for him... and when it didnt work for him she would pick them up.. she also said she doesnt think he is unfit.. and that she was EASING into the 50/50 thing.. which is betterr for the kids instead of messing with their lives more.. they just separated not long ago... hes the one trying to throw power at her.. cuz he knows just like any other man.. a moms greatest fear is losing time with her kids. you ALSO dont know why they split up... if he decided to walk out on all of them.. doesnt really say much. think before u run ur mouth thinking you know absolutely everything... The police can be called regardless, even if they are just arguing. If they are called they will become involved and attempt to settle any dispute. Then it will be on the record that there was a problem.

She was giving him 4 days a month. With a couple extra if possible.

She said she had the idea of weaning....not that she was working on it.

No. If its civil, they will tell you to put on your grown up pants and deal with it and stop wasting their time. They don't have to write a report for something not criminal.

Yeah.

Because obviously it was working out. its only been a MONTH. and yeah they set up friday to sunday and occasional extra nights if it worked for HIM... she was working WITH him not AGAINST him.

Actually, it is. If he's the father and there's no custody agreement, he has every right to keep the children - just as she does. That's why custody agreements are always a good idea.

IF he did call the police it would be for a reason. He could say whatever he wants to the police to get them to side with him. Because the children are in HIS house he has custody of them. He could use the power of the police to get her to leave the children there. (I'm positive there is a law where we live that states if there is no court ordered child custody arrangement in place that whoever has the children is in custody.)

Either way she needs to go get an arrangement figured out so he can't say "Hey, leave the kids here or I'm calling the cops." It isn't healthy to confuse the children or fight about when to give them back.

Police have no say in custody issues. It's civil. And they don't have a legal agreement so he's not breaking any laws by keeping them.
