legal question ..

If there are any mistakes on a police/ report/affidavit can a case be dismissed?

Not in my case. I had a speeding ticket that had my name COMPLETELY wrong ( a totally different name) and had other incorrect info on it and I STILL had to pay it. I asked them at court and they said it's didn't matter. This was on a military post though

Yea I hope so too in my case .. I may have to ask a lawyer but yeah I thought I would ask anywhere here ...

Like the report says "Suspect Oneal" and my last name is lopez lol .. so idk if that counts for anything

No, but he used to work at a state prison. He worked with law enforcement a lot.

My SO was pulled over a few days ago because our tail lights weren't working & got a ticket for no license. The officer put his court date as april 2012. He's hoping it will get dropped

If he has a license but didn't have it on him at the time, I always thought that was like a fix it ticket. You prove that you had a valid license at the time and it's done. Maybe he just has to go to court and show his license?

More than likely not. A police report is like a police's witness statement so unless it is like complete and utter bullsmurf, it more than likely a case or charge would not get dismissed. Something like your name, wouldn't get it dismissed.

In most cases they won't dismiss because the info is wrong unless they have the wrong person. Initial reports are made quick and on the fly. If the officer can say "yes that is the person we are perusing charges upon." that's all that matters. Some magistrates are more lenient than others when it comes to misprints.

The licence/tail light thing is a state by state basis. Some states will cite you because it is the law to have an ID on your person at all times, so you will have to search the state laws.

Nope he doesn't have a valid license. He can get it back but he has to wait for his taxes so he can pay off his fine. He SHOULD have it by the time he goes to court
