do you write checks for the daycare? If so that will have his name on it and the daycare will have copies..If its in cash that can be a bit more trickier.

That's what the code is, and she can go and get that at any point in time, and my SO just of course went along with it. That's a whole other 900 dollars. That WE should get back because it comes from OUR bank/household income etc.,

First of all, stop paying in cash. That's just stupid. Where is he getting these receipts from?

No we're taking her to court to finally get one drawn up. It's been verbal but with me being pregnant she's been up and down about the whole thing. And What they do is claim him based on whoever will get more. But no one said she was claiming the thousands of dollars we spend on his day care. That's 400 a mo. Every mo. all year.

It's not even in the verbal agreement he started paying it because she can't afford to.

If you have proof you guys paid for it, you guys could file for the credit as well. You both will be flagged and audited and, if they feel you have enough proof, you will win, thus getting the credit.

From now on, I would tell SO to pay the daycare directly, and get receipts from them.

The day care? They draw up receipts to keep on file. He pays in cash, and gets a receipt every week. And they give you a code to put on your tax papers stating proof.

Claiming him based on whoever will get more is illegal. Whoever provides for him most can legally claim him. Better hope the IRS doesn't catch wind of that.

I was assuming that he was getting receipts every time he gives his ex money for the daycare. Like a bootleg handwritten receipt from his ex.

I see. Then I'd claim the daycare if I was him. Both him and his ex will be audited and he will have the proof that he pays and she doesn't.
