I believe this depends on your state laws. My cousin was in this exact situation, she was the one who was going to be taking custody of the baby and since the girl who was pregnant failed the drug test at the hospital and her baby did also, the state took custody of the baby and put him in foster care.

Aw that's sad :/ This women was on drugs also but I don't think she has been doing it while pregnant.
