No, not at all. If he's homeless, where is he going to stay with the child? Seems like a valid concern to me if he can't put a roof over the child's head. He could always petition for custody again when he has a stable home.

Generally a mother is going to get custody anyways.

If he's homeless I wouldn't have my kid around him.

Depends on the state. Many states are completely 50/50, and try and get everything as close to 50/50 as possible for the mother and father. NYS is one.

Varies. Half way houses, crises centers, and sometimes friends... hut not long term.

It will probably temporarily go to the mother, and then when he was in permanent housing again get reset and start the process over again if he pursued it.

That doesn't seem malicious at all...I wouldn't want my child living in that kind of environment. I would let him have visitation of some kind (maybe supervised) until he gets a stable home.

Just because he's homeless doesn't mean he shouldn't see his kid. The judge will probably leave visitation up to the mother & no overnight stays. Maybe you can meet up at a park for a couple hours or set up something at a visiting center (?)

You see the pattern? Generally it takes a lot of bad decisions to have no more bridges and have to live on the street when you're a grown man with a child.
