Child Support- Military Overseas?

Does anyone have experience in getting a father to pay more in child support when living on a military base overseas? I have been told they can't be served/or forced to pay until back in the states. Is this true?

Why would the father pay more when living overseas? The extra pay is for them to help with the cost of living over there.

You don't know the situation. Child support can need to be raised for a million different reasons.

Yes.

The child support needs to be raised.

But he's not in this country, so how does she go about doing it?

And if you look at her past posts, she's been trying to raise his child support amount for two years since it was set at $250 a month in May of 2011. He's been stationed overseas and she's been told that he can't be served with papers until he comes back home.


Unfortunately I have no experience here. My friend in the AF reported to them that he had two kids that he needed to pay CS for and they just automatically take his pay out for him.

If all you get is 250.00 a month for child support...I'd raise that to! That's BS.

I didn't see it as wanting to raise it solely because he's making more while overseas. He just happens to BE overseas and in the military while child support needs to be raised.

I only get 200 a month. O_o. Well I'm supposed to get 200. He hasn't paid it in well over a year and has never paid it regularly.

Sorry , no what I mean is that I need to raise my child support. He is currently paying $250 a month. But now he is living overseas so how do I go about getting the amount raised when he is not in the states.

You probably need to get a lawyer. What country is he in?

I had to have my now ex served with divorce papers while he was in Germany, and it was a mess. Because they can't be served by a process server over there, they have to accept service OR in my case we would have had to use the Hague Convention guidelines for international divorce. That would have entailed waiting forever and paying tons of $$ to have the papers translated, go through the host country's government and have them serve him.

I know this is a CS issue and not a divorce, but a couple things: 1) You could try JAG, but they most likely will not help you, 2) I'm guessing there might be a similar process you have to go through if he's not willing to accept service, and 3) you could also try his command to have him served through them, but they have no obligation to you and it's likely they won't help you either.
