No you don't have a case. Even if she had some permanent damage you may not be able to receive any money. There was a case here in town against an OB that caused during birth a baby unable to raise her arm. The baby was 4 when the case was finally over and they didnt receive any money.

Don't sue. Patients/families bringing bullsmurf complaints like this against small hospitals when patients/families really don't have any real idea of what even was going on or WHY certain interventions were done just PISSES me off. You realize that the days of the smaller hospitals are numbered because they can't foot the bill for malpractice claims anymore- more often than not the claims are bogus and the hospitals are forced to settle anyhow because A.) it's bad publicity B.) even if the hospital did nothing wrong, paying lawyers on their behalf to prove theyre right is often more expensive than just settling. AND BECAUSE OF THAT doctors are very hard to recruit to smaller hospitals because they don't want to have their claims settled, they want their names cleared. Grrr don't get me started on this crap. I HATE sue happy patients

If there is no permanent damage, then suing is a waste of your time and the hospitals time. They were doing what they could to save your child's life. So no Don't Sue.

You have to prove that the hospital violated the standard of care and as a result caused her actual harm.

Here is an idea why don't you ask your parents what on earth it is they want to sue for exactly? Has she got permanent damage? No. Did they transfer her to a Hospital which could better care for her when they realised that's what she needed? Yes. Was there even any short term damage to your daughter? No. So yes ask them what exactly it is they want to sue for because I really can't see a reason, chances are they probably don't even know either. Unfortunately they probably see an opportunity to drain money out of someone and want to take it, what a joke. That's the problem people want to sue a hospital for doing nothing more than their job, then they are left in debt and can't afford to run properly or at all and then peoples lives really do end up at risk. So yes you could explain that to your parents that because they want to make a quick buck they really could put another child's health at risk, completey selfish .

Same here, We keep being told we could sue for my epidural and the factthat it took them 8 years and 6 babies to diagnose lupus but honeslty I odnt think me having a smurf load of money can stop the hurt and it wont stop me having had a traumatic failed epidural.
