Parental rights

Question: In mo, I am not married, however I can put the fathers name on the birth certificate and sign the parental affadavit saying who the father is.. However, if the the father wants custody he has to take me to court... Is this all correct? Questions/ comments??

If he's on the BC, he has rights. The "physical custody" is generally who the child lives with in most states... but if he's on the BC denying him visitation and stuff will not look good for you if he does decide to take you to court for custody, KWIM?

He would have equal rights until visitation order was put into place.

Kwim? i dont understand the accronym. The reason for all of this is he has not contributed to anything for the baby soon to be. I am a full time teacher, pay all the bills, and the father to be has a part time job and hasnt gotten a full time job to support the baby. I have paid all the dr. bills, copays for the birth, everything.

Custody has zero to do with child support.

My DD is almost 4 years old, her father has never paid a dime, still gets to see her on a regular basis. Denying him visitation is not a good thing to do. If you don't want him to have rights... don't put him on the BC... though he could still go through the courts and get put on the BC if he so chooses.

who ordered he gets to see her? a court? see thats the thing the babys dad has no money to take me to court.

than dont put him on the birth certificate but if his name is on it he has rights as her father

You don't need money to take someone to family court, really. You can do it all without a lawyer.

My sister is in family law. We have no court agreement because the courts would give him more time than we agreed upon between each other (and would still get that time despite not contributing financially).

And if she doesn't put his name on, he can easily go to family court and request a paternity test and to be put on the BC.

it doesnt matter if your married or not he still has rights im going through the same thing with my kids father right now

Him being on the birth certificate means he has equal rights until you take him to court to state otherwise. He could take your baby whenever he pleases and for as long as he wants and as long as there is no visitation order in place the police can not do that a thing. My sister in law's ex took her sons for 2 months and she couldn't get them back.

Hmm, guess i will set up a consultation with a lawyer my friend who is in a similar situation has full custody and everything but i will find out for sure what to do before my baby arrives this coming friday.
