Child support court.

BD and I have been in and out of child support court.
He also has another child, so she is there for her order as well as ours.
Well, he did 30 days in jail back in Dec-Jan 2011-2012 for failure to pay support.
Though, he was paying partial support it wasn't enough in the judges eye.
Well, we go back again on Feb 13th for a sentencing hearing again for another failure to pay. Yet again, it's been partial payments. I haven't gotten a full payment in over a year, though. I've received close to a full payment 3 weeks in a row, in December. He hasn't paid any of his monthly arrears either.
He's now facing 120 days in jail, and it's around the time our LO is due.
We are not together, but he is active in our son's life.. as well as his daughters life. but the judge has already stated that isn't enough to keep him our of jail.
He is ordered to do the "seek work" program through the state, but I don't think he has done it at all since early 2012.
I guess my question is, even though he is working, and has been in trouble previously before.. do you think the judge will send him to jail again?
He was facing 60 days the first time, but she only made him serve 30 days.
This time, his work told him they will not hold his job if he goes to jail.

If it's the SAME offense, I'm sure they'll send him back to jail again...

i dont see why the judge is being a bitch, But i would hope they would not since he is paying some support. My DH pays full support but not on time its always in the month they are taking on late payment fees i mean come on really. We are going to pay the rest of the back pay with taxes tho.

I think the judges concern is, he is ordered to pay $281 a month for my son, and around $250 for his daughter, but only pays around $150 for each a month. He is behind slightly over $5,650 for my son alone.

dose he make decent money or no?

I don't get how sending him to jail when he has a job is going to solve him being already behind. I don't get why they do that.

I mean, decent enough for around the area where we live.
I'd say about $350 a week.

and she could order it to be garnished out of his check in steed of making him go to jail that wont solve him being behind.It will make him more behind because he wont have a job when he gets out. To me its stupid

It does already come directly from his checks.

I dont see why his support is so much afte support and taxes he makes under 800 a month i cant even survive on that and we make just about 800 a month.

Because both of us, (his kids moms) are receiving state assistance, they take 60% of his monthly income into consideration for his child support. which I believe is what they are taking out for us currently. IDK, but when they figured out our support, I was receiving over $300 a month. They did lower it, when he got a different job. so it's about $65 less now, than before.

My DH ex is on state help and we are as well it still didnt matter about her state help.

I know it varies by state, but that's how it is in Ohio.
he is also required to pay all medical expenses that the gov't medical insurance doesn't cover. I'm only responsible for 10% of the medical cost. but luckily, medical covers pretty much everything besides ER visits.
However, I do believe he should be paying his child support BUT do not agree with sending him to jail because he can't pay full payments. I'd rather have something, over nothing. Especially now that I'm on maternity leave until at least April 1st.

We don't get any say in his sentencing.
We tried the first time around and she said it didn't matter.
She has the final say.
