Ca he chage his last name?

DS's fathers wife keeps saying they are going to court to change the child support order and to change DS's Last name to his. Ive been looking for it but cant find any info. Im in texas, can he really change his last name?

He either needs your permission, or he can ask the courts to change it.

Also, YOU don't need to agree with changes to a court order if the courts make changes to them. However, you can fight the changes.

Does he currently have your last name?? I don't know if the law is different in Texas but I'm pretty sure that unless he has full custody of your son (and maybe even your rights terminated) he can't just change the name without your consent. Even then I don't know if he could.

No my attorney and the child support office said the court order is final and nothing can be changed (for him anyway) unless I agree. He is trying to change it so he can get DS on weekends but he has only did one visitation

Yes he has my last name and I saw on yahoo someone said for texas we both have to sign some paperwork in front of a notary but I wasnt sure if I could fully believe that comment ya know.

He can go back to court and request a change....he is completely within his legal rights to do so.

in ca.. ex asked that my daughter get his last name (absentee father) they asked him why is his name any more importiant then my last name.. and they wouldnt change it.. they said when shes older and if she wants it changed then they will discuss it at that point

My brother was in this situation. His son's last name did not reflect his. He took his son's mother to court over it. Due to him testing as the biological father and paying his child support, the court granted him rights to his son's last name. So my nephews name was changed to my brothers and it was ordered from the court to the mother she had O so many days to change his BC.

We live in Arkansas BTW.

Yeah thats true but they said I have to agree with any visitation changes.

You asked about changing his last name....not visitation.

Also, if the courts decide that he deserves more time, they don't need your permission.

Anything can be taken back to court in regaurds to a child and custody.
