Im sure you can just ask the judge when you go tomorrow. I would ask for support sot hat when he does get a job they can take it from his checks.. What does his mom mean when she said "No employer will ever higher him with that hanging over him". Is she talking about they wont hire because of his convictions or because he owes support?

She said because he would owe support and they don't wanna bother with the wage garnishment.
but I feel that since California is so hard core about father's rights that it's a fair trade off that if he ever does get his life together he should have to pay. because Me and my family are the only one's supporting my daughter yet I've been told he will still get visits regardless of not paying a dime.

An employer wont know that he owes support until AFTER he's already hired so what his mom says makes no sense. Any yes he can still get visits if he doesnt pay cs. I would file for it and you will get some money from his sooner or later. Good luck

Agree it sounds like bull. She just wants to protect her son from the consequences of his actions like she has always done. A big factor in why he is who he is, if you ask me.
So I can ask for support still even though I didn't when I first filed?
and can I ask the judge to compel him to take a breathalizer before and after he takes her given his extensive history with drinking?
He may not respond at all because I think he has a warrent

Im not sure about the BA but you could request supervised visits at a center. (?) My BIL has to go to a center and then his ex drops off their daughter and a social worker sits in the playroom during the visit

Your ex-husband sounds like my ex-boyfriend. You can still ask the judge for child support. IMO it's only fair that he pays child support since he helped make your daughter. I don't think the judge will make him do a breathalyzer but you should still ask about it. I agree with the post above mine, you could request that he has supervised visits a center.

I am kind of fearful if I do that his mom is going to lose her smurf and it's gonna get ugly. but I would really prefer that if he must see her, especially if he's not going to pay while back child support builds up and he's still drinking, he should be seeing her with someone to make sure DD is safe. Whether it's his mom or a social worker as long as his alcoholism isn't putting DD in danger.
