Depending on custody arrangements ....honestly if it's his scheduled through court you can go against it if you feel the need to.

Tell him maybe at his place just not her place maybe. Or keep lo home

My son is 3. And we have an agreement out of court with scheduled times and days today isn't even his day to have him.

Okay, then I'd say no. But if it's during his scheduled time... going against it might hurt your case if he ever took you back to court, so be careful with that. <3
