Custody!

So my mom heard a rumor that in the state of Nebraska that if your a single parent...that the state has full custody but the parent has primary custody? she's heard this couple years ago..has anyone heard of this?

AND! I know in the last couple of my postings i was having problems with my BD, well we are trying to work things out on being Civil, he's 'suppose' to be out of jail in August of this year. He swears up and down he has changed,, he wants us to go to a relationship therapist...my way of thinking is since he's been in jail for a year by the time he gets out, he had time to sit there and think about all the smurf he has done to my daughter and me. you know what if he does change? I give him the benefit of the doubt since he came clean to me about A LOT of stuff. Ive gotten letters from him stating he has never loved anyone like he has loved me, I've never had a guy CRY so much over me like he has but I told him i'll think about giving him another chance, but if things don't work out he needs to be there for his daughter no matter what which he wants to be there, he wants to a father. He realizes he smurfed things up, but he wants to make things wrong and prove himself to me. Now I'm kind of worried that if i let him be a part of our life, and things don't work out..he try to take my daughter away from me and go back to New York with her. I've tried contacting legal aid, i had no luck with that....who else can i contact to get more info/to take action? I can't afford a lawyer right now. would it work if he will be living with me at the time, for the time being? I just don't want to be the bad guy, deny their rights of seeing eachother when he wants to be there for her, you know? His sister and mom said I should come to New York and file...but thats 18 hours away and I don't think i can afford that right now anyways.

Mind you...he has 3 other kids with another women, When i was up in New York living with him, i came back to Nebraska to see my mom, and then i had to come back last July for good, and he ended up in jail 2 weeks after i left. He has seen his 3 other kids maybe once or 2 in that month time span.. His other baby momma is crazy and is the type of bm to not let him see his kids, cause while i was up there, she done it before. Whenever he would take her to court, she would make a bullsmurf lie to make the judge believe her. which thats what i'm kind of afraid of, that he says he will be there but it will end up like how it was when i was gone. He could've put on a front with me you know? i'm not sure if that make sense.

1. That is untrue. The state does not have custody of your child unless you put your child in foster care.

2. You can file for custody on your own, you don't need a lawyer. File for full legal and physical custody.

Kaylee's dad is a jail reg lately (currently in right now) last time he got out of prison after over a year he talked this big game on how he was clean and found God and turned his life around (i called bs) sure enough within 6 months he wasnt clean and wasnt all about God and was back to being locked up.. my advice is not to automitically just go running back as soon as hes out.. make him show hes changed..

Go to your county courthouse and they can help you.

lol it made me cry to see the letters ex wrote my daughter while in jail.. all lies
