Question about unemployment(Long ish)

posted 13th Jan
My SO developed really bad carpal tunnel from where he works because all he does is one repetitive motion for 8-10 hours a day. He has told his managers about this problem and they still make him work instead of switching his position which he is already trained on everything else.. He told his highest up manager yesterday that he can no longer do what he does and that manager said okay and that he will have someone help him.. well he just texted me saying he has no help and he can't take it anymore. If he were to quit because of that reason, would he be able to get unemployment? Or does it never matter the reason you quit that you can never get unemployment like that? Is there anything he can do besides going to work everyday until he is disabled in that hand? (He doesn't have insurance, they only have one time a year to sign up and he missed it apparently even though he has asked his managers when he can)

even without insurance, he should be able to file an injury and have worker's comp insurance cover an appointment or surgery to get it fixed.

He has already asked his managers about it, for a month or more now, and the highest up manager he talked to said he will file it tomorrow. That should have happened a long time ago and they are also making him work still when he can do another job there besides the one he does. This manager he told said he wouldn't have to do the thing that it's hurting him today but he ended up having to. He has to cut meat, onions, oregano, an other things all day into precise pieces for hours and hours non stop. He comes home and can't even pick up a glass to drink out of without pain.

I found this:

Can you collect unemployment benefits if you willingly quit your job? That depends on a number of factors.
Your state unemployment office will allow you the opportunity to have a hearing on your case. At this point it’s up to you to convince them that your quitting was not your intention, but the result of adverse or unsafe working conditions, abuse and harassment or some other reason that made it a “bad” place to continue working. So, it’s possible to be eligible to file for unemployment if you’ve quit, but you must have just cause.

I remember when I quit my last job I told my boss I was leaving in 2 weeks. He asked me to write it out on paper, date and sign my name. I'm almost positive it was so that I couldn't file for unemployment after I left.
I would research it more, but I'm sure there is something he can do.

Thanks. I don't see how they can just keep making him do something that he has said he really can't. Ughh
I'll tell him not to write anything down if he quits

you also have to put it into factor that depending how long he has worked he can only claim unemployment for so long, then your money less. So he really has to think it through on what he needs to do.
My SO is in tons of pain everyday from being a breakman on a bobsled, has bruises that need to be watched for blood clots because they are so bad, and he still works because unemployment only lasts so long and you really dont get as much as you would working.

I would go to HR if hes gone to managment multiple times.. every place of employment is suppose to have workman comp info hanging up (atleast here i was told they did) there it will tell him what to do to file a claim.. he might not get to go on disability but maybe modification.. and when i went on workmans comp for a knee injury at work the couldnt cut my hours or anything and had to accomidate my injury (sitting only if having to walk.. no more then 5+ minutes with out sitting down..

I know what unemployment is. He is tons of other pain too and puts up with it but when it's something he needs surgery for and they make him work on it is completely smurfed up and he could become disabled and not be able to use his hand at all.

That's good to know. I can't believe they aren't already modifying his work.

unless its done through workman's comp they dont have to modify it if they dont want to they can tell him to have the dr put him on temp disability because they wont modify it.. and he would have to have proof it came from work.. a friend went through a lawsuit over carpal tunnel.. and they said how can they say it was from them and not the 3000-5000 texts a month she sends.. and if her hand is well enough to type on facebook and text it cant be that bad... they are still going through court

But he can play video games all day?! that just doesnt make sense.
And technically if he has not saw a doctor, he doesnt know for sure it is carpal tunnel, there are many things they can do to fix it. They can cut his wrist and pull the nerve off his bone, or do some shots, i dont believe they can say hes disabled because of unknown carpal tunnel.
