Question about court?

posted 13th Jan
I have court on the 16th about interim hearing about my LO and contact with BD before the alcohol results

We had to write statements and BD wrote his which was completely full of smurf, some of the stuff saying like I'm good with children because my gf works in a nursery (he's never even seen my LO let alone taken care of him) He's even lied about looking after children. It's the stupid smurf like he says he can't even afford the contact centre because he has to pay CSA so he wants them to make us do it outside despite the fact he's threatened to kidnap LO we had an agreement before he threatened to kidnap LO for 30 mins a week with just him, me and a mutual party in a mutual place if he passed the drugs, alcohol and dna test (he doubted he was his so court ordered it) and he refused because he didn't want to see him because his gf wasn't allowed to come. He use to sit outside my house and watch me to the point I was put on meds for anxiety because he got his friends to follow me. To top it of he ended his statement with I can not offer consistency.

What I want to know is what is the likely hood of the court agree to him seeing before the results of the alcohol test especially with the smurf he's said in his statement. Has anyone had experience in Interim Court hearings with Family court?

It really depends on where you live. Like in South Carolina it's a pro-mother state. Meaning the mom gets full custody and the dads get every other weekend NO matter what, unless the mother agrees to have joint or the father has a kick ass lawyer. In New Jersey, it's a joint custody state unless the father is proven unfit.
If he has ever been in trouble with the law that would work against him.
But court systems know that ppl get dirty when it comes to their kids and say a lot of stuff just to make themselves look good and the other parent to look unfit.

Yeah

I mean we agreed visitation and he refused to attend then he took me to court saying I refused to let him see him and then got bollocked by the court when I gave them the letter proving he refused to say him. I'm just worried he's gonna hurt him he's already told the court he can't offer consistency and can't afford to go see him I just don't want him in and out of his life when he see's fit or can be bothered
