I don't think so, unless he has joint physical care and has him 50% of the time

Unless he has him 50/50 it's not going to really matter and even then one parent usually has to pay some.

Yeah, from what I understand it really only matters if he goes from not seeing him at all to having visitation of him or if he goes from having just visitation to having joint physical care. If he just gets him a couple extra days it really won't change much if at all

OP, if your SO is already paying half of daycare and has proof of that, the court will take that into consideration. With my ex, daycare for our daughter was factored separately, because she won't be in daycare once she starts kindergarten in August. My ex pays $526 per month for her, but the laws here state that even if I am not working, they have to figure in an income amount as if I was working a minimum wage job. He is also supposed to carry insurance on her, but he does not, I had to get her on Medicaid after he stopped paying the insurance premiums. I COULD take him back to court on that ground, but it's not worth it.

In Virginia, they take what the Custodial Parent is paying for child care and what both parents are paying towards health insurance into consideration.

They also take both of their incomes into consideration.

Throwing some numbers into the Child Support Calculator for Virginia, if he is making more than $2000 a month gross and she is making around $1500 a month gross and paying around $400 a month for daycare it comes to more than $600 a month.

It's possible she is concerned he will stop supporting his first child because he is having another child with you. It happens all the time.

We try to make him feel as loved and welcomed at our house as possible. He has everything he needs. and when we buy him clothes we'v started keeping them at out house because if we send them home with him we never see them again. I'v asked for his input on all kinds of things when it comes to the baby.. but yet she still tells him (the 7yo) that his daddy has a new family and dosent care about them anymore blah blah blah. she's childish when it comes to this stuff. It's sad how hard SO does try and still she just smurfs on him and tries to make him out to be so bad... it breaks my heart.

My DH pays child support this is not true they can only take X amount out of his checks because they have to leave him something to live with after child support is paid and we pay back pay some months we only bring home 600 sometimes a bit more... Here they take both partys incomes and then figure out the amount due... We do not pay medical because his other daughter has medicaid and we do not pay day care.

We have a child together and i have one from my ex.... They don't take my daughter into account because his other daughter was first...

If i ever get anything from my ex it wont be much but it would be less the his other BM because the first one always gets more then the second.

True, but sad how they consider one child more of a priority then the other... but the thing is what is gonna piss his BM off even more is that were gonna stick through it pay her her smurfing ass money and we'll make it even with all her negativity.

we pay it, its the right thing to do but my SO does not see her theres a lot of factors that go into that as im a full time student now he works part time and we have to kids in our house hold.

SO does see his son as much as he can .. we will have a new baby come April & i was strongly considering going back to school in the fall thought that will have to be put on hold now..

Child support doesn't have to stop you from doing things.

'cause with this big financial hit there's just no way id be able to pay for it right now. At lest not until we know exactly what were working with.. he goes to court on the 22nd. sooo maybe by the time fall semester starts things will pan out... hopfully!

this my books and classes are all covered by my pell grant as long as i take 12 credit hours witch is full time and i am taking 12 credit hours...I'd be getting back normaly about 1000 after books and classes are paid how ever because we paid out of pocket ill be getting almost the whole thing back i had to buy another book so i just charged it to my aid.

Her child deserves just as much as yours does! I didn't read all the comments but my baby's fathers other baby mama thinks her kid deserves it all and that he shouldn't have to pay for my son. I am not saying that's how you are at all but I just think her son shouldn't get the smurf end of it because he made a new baby.
