I want to say no because she did consent to sexual intercourse with him. Should a woman who conveniently forgets to take birth control or lies about it to her sex partner be considered a rapist? That's where I'm drawing my "no" from. If it wouldn't be the same for her, then it wouldn't be the same for him.

No, it's not rape because you have consented to the sexual physical contact and his juices include with that consent even if you don't want them too.
Pre cum and other fluids come out without knowledge and probing he did it on purpose is impossible.

I know that if he has an std and is aware of it that it can actually be some degree of preplanned murder...I know that is not the correct wording but it happens to soldiers alot down here....I dont know for sure tho about that but I am sure there is some way out there it could be illegal ....as for personal opinion no I wouldnt consider it rape unless halfway in the act the girl said no and he held her down then its date rape....there are alot of specifics to it and rarely in that kind of situation would anyone be convicted....if the girl got pregnant she could say he raped her even with proof of the plan before hand technically it would be a lie in a sense but idk thats actually something to think about....
